The development of laws on domestic violence against children in Families

Abstract

The aim of this article is to develop laws on domestic violence against children, such as methods to punish the perpetrators of domestic violence and have the court determine the measures of the penalties for the perpetrators and to propose guildelines and measures for child protection from domestic violence.

This article also recommends the methods of having a child protection policy for domestic acts of violence in the family by conducting a qualitative research methodology which consists of written documents, going into the fields to document the evidence with a team of professionals, and hearing the opinions to improve the laws of domestic acts of violence against children.

            The findings of this research: 1) the enforcement of the law was not enforced enough as it should be.    2) The main legal problems and limitations of the law. 3) The time periods for the competent authority to determine the measures or the methods to provide support and help the victim of the violence.

            This research article recommends making amends to the “Victims of Domestic Violence Victim Protection Act, B.E.2550” by canceling all 4 Sections and making an addition to the law that gives power to the authorities to 1) file a complaint when it is the case the victim is a child  2)  provide clarity for issuing orders to determine measures. 3) to provide relief and support to the victim and the committer in the family. Because the problems in the family are delicate and complex matters, enforcing criminal measures for domestic violence will not be suitable.  The purpose of this is to conserve the relationship in the family and to give the chance to the committer to amend themselves and refrain from repeating the offense.      The child and the family will have the right to protection from the state from acts of violence and unfair treatment.
