Conference Report: 1st PSAT International Conference “Inequality and Social Justice Sensitivity”

This article reports on the inaugural International Conference of the Public Sociology Association (Thailand), themed “Inequality and Social Justice Sensitivity” and the key messages drawn from the conference and pre-conference talks and discussions. The event featured a keynote address by Professor Guy Standing from SOAS University of London, United Kingdom. Attracting over 150 participants, the conference included 16 parallel sessions and showcased 36 abstracts. This gathering provided a significant platform for the exchange of ideas regarding systemic inequality and social justice in Thailand, focusing on addressing contemporary social and economic challenges.

Social determinants of drug use and the development of the quality of life of drug users

The drug problem has adverse effects on individuals and society and is a severe problem in every society. When individuals use drugs and become addicted, it affects not only their own quality of life but also that of the people around them. This article aims to identify the social determinants of drug use in order to develop guidelines for improving the quality of life of drug addicts. This study used qualitative research and collected data from 25 drug users who had undergone treatment through snowball sampling. The study revealed that social factors determining drug use can be categorized into two main parts: personal factors and environmental factors, which include the lifestyle and behavior of people around the drug user, their social networks and communities, as well as societal structures. Therefore, addressing these factors at each level can contribute to improving the quality of life among drug users. Ultimately, a good quality of life for drug users entails having a stable life both economically and socially, maintaining positive relationships with others, having freedom in decision-making, and experiencing physical well-being, as well as enjoying good family life.

Role of the National Sports Tribunal in the Australian Sport Justice

This paper focuses on the role of the National Sports Tribunal (NST) in the Australian sport justice, and its positive effect on regulatory functions for protecting sports participants against unfair practices and giving sports stakeholders’ additional rights in respect of good practices in sports proceeding for maintaining more fairness and integrity in sports. It also focuses on functions of the NST in the field of independent, effective and efficient dispute resolution services to sporting governing bodies, athletes and all relevant sports participants. It outlines the background to the National Sports Tribunal Act 2019 and considers the sports dispute resolution provisions found in the Act. It particularly looks at the rights of access to sports justice and considers how the Act treats unfair terms in Australian sports. This paper analyses a number of legal challenges related to consideration of using an alternative dispute resolution service under the Act.

Health Policies for Addressing COVID-19 among Migrant Worker Populations: Case Studies of Singapore, Germany, and South Korea

The global outbreak of COVID-19 in early 2020 posed a significant public health challenge for governments worldwide. Migrant workers constituted a high-risk group disproportionately impacted by the pandemic, facing issues such as discrimination, employment and housing insecurity, restricted mobility, and inadequate access to state welfare provisions. This study aimed to comparatively examine the policies adopted for managing migrant worker populations in Singapore, South Korea, and Germany during the initial phases of the COVID-19 outbreak through documentary research. The findings revealed that countries with robust labor laws, health policies, and social security systems, such as Germany, required minimal additional special measures. In contrast, nations like Singapore, where existing legal frameworks lacked comprehensive coverage for migrant workers, had to increasingly rely on ad-hoc welfare measures, involving private sectors that economically benefited from their labor forces in sharing the financial burden. South Korea's approach demonstrated that regularizing the status of undocumented migrant workers enhanced disease control efficacy and exemplified timely crisis-responsive management of migrant worker populations.

วารสารที่เผยแพร่ฉบับนี้ เริ่มต้นจากการย้อนกลับไปทบทวนภาพความเหลื่อมล้ำและความไม่เป็นธรรมในสังคมไทย สืบเนื่องจากในรอบหลายปีที่ผ่านมาสังคมไทยถกเถียงกันเรื่องความเหลื่อมล้ำสูงติดอันดับโลก เหตุปัจจัยของความเหลื่อมล้ำและความไม่เป็นธรรมมีหลายประการ งานวิจัยชิ้นสำคัญที่ควรจะกลับไปอ่านที่ผู้เขียนอยากแนะนำคือ งานที่ ศาสตราจารย์ ผาสุก พงษ์ไพจิตรทั้งเขียนและเป็นบรรณาธิการด้วย เรื่อง สู่สังคมไทยเสมอหน้า (2557) ซึ่งเป็นงานชิ้นหลักที่รวบรวมงานวิจัยอีกหลายชิ้นที่ชี้ให้เห็นเหตุปัจจัยความเหลื่อมล้ำทางเศรษฐกิจ อำนาจ และเครือข่ายการศึกษาระดับสูงที่ทั้งสร้างและผลิตซ้ำความเหลื่อมล้ำและความไม่เป็นธรรมทางสังคม และเป็นหนึ่งในงานที่ อนรรฆ พิทักษ์ธานิน (2557) อ่านทบทวนวรรณกรรมที่เกี่ยวข้องบางส่วน กระนั้นก็ยังเห็นเหตุปัจจัยที่ชัดเจนว่าความเหลื่อมล้ำในสังคมไทยมีสาเหตุมาจาก “ความไม่เป็นธรรม”

The objectivity of Judicial Decision Making

ในรอบหลายปีที่ผ่านมา อารมณ์ความรู้สึกของสังคมไทยต่อความเชื่อมั่นในระบบความยุติธรรมกลายเป็นกระแสซุบซิบนินทาในที่สาธารณะมากขึ้น โดยเฉพาะในการตัดสินคดีความ การพิพากษา และคำสั่งต่าง ๆ ของศาลยุติธรรมบางคดีความที่นำไปสู่การตั้งคำถามถึงความเที่ยงตรงในการตัดสิน ความรอบคอบและการตรวจสอบพยานหลักฐานและวัตถุพยานแวดล้อมอย่างครบถ้วนรอบด้านและเป็นไปอย่างโปร่งใสตรวจสอบได้อย่างตรงไปตรงมา กล่าวเป็นภาษาของสังคมทั่วไป คือ ค้านอารมณ์ความรู้สึก หรือ ค้างคาใจในคำพิพากษาตัดสิน หรือไม่เห็นด้วยกับคำสั่งศาล เป็นต้น อย่างไรก็ดี เนื่องจากศาลมักกล่าวอ้างถึง “ละเมิดอำนาจศาล” หรือ “ดูหมิ่นศาล” ดังนั้น การวิพากษ์วิจารณ์อย่างตรงไปตรงมาจึงมักปรากฏอยู่ในแวดวงของนักวิชาการผู้เชี่ยวชาญทางกฎหมายไม่กี่คนซึ่งปรากฏการณ์เช่นนี้มีแต่ทำให้ความเชื่อมั่นต่อระบบความยุติธรรมของศาลไทยอยู่ในภาวะอึมครึม ยิ่งกว่านั้นสำหรับสังคมไทย การซุบซิบนินทาและการวิพากษ์วิจารณ์ในที่สาธารณะทั่วไปเป็นอีกวัฒนธรรมในชีวิตประจำวันที่พบได้ทั่วไปและมีแนวโน้มว่าประชาชนจะไม่เชื่อมั่นมากขึ้นในกระบวนการความยุติธรรมในการพิจารณาตัดสินคดีด้วยความเที่ยงธรรม ปานเทพ สุ่มมาตย์และคณะ (2566: 2) ยกตัวอย่างคำสั่งที่เป็นปัญหาในปัจจุบัน เช่น เรื่องการปล่อยตัวชั่วคราวบุคคลในคดีอาญาที่มีข้อโต้เถียง และการวิพากษ์วิจารณ์มากจากสังคม โดยเฉพาะคำสั่งในคดีการเมืองที่มีประเด็นว่า มาตรการควบคุมระหว่างการดำเนินคดีหรือระหว่างการพิจารณาเกินสัดส่วนหรือไม่ ซึ่งสังคมเรียกร้องให้ศาลมีคำสั่งที่มีมาตรฐานเช่นเดียวกันการจัดทำคำพิพากษาด้วย
