กรอบและแนวทางการนำแผนและผังเมืองไปปฏิบัติสำหรับหน่วยงานท้องถิ่น

Abstract

        การวางแผนพัฒนาและผังเมืองสมัยใหม่ในประเทศไทยเริ่มมาตั้งแต่หลังปี พ.ศ.2500 แต่การวางผังเมืองไม่ได้ก้าวไปไกลจากผังเมืองแบบ ‘ผังเมืองรวม’ ตามพ.ร.บ การผังเมือง พ.ศ. 2518 ผลงานที่ปรากฏมีเพียงผังเมืองรวมเท่านั้น ในขณะที่การวางผังเมืองเฉพาะยังไม่ประสบความสำเร็จผังเมืองรวมหลายผังในปัจจุบันหมดอายุและไม่สามารถใช้บังคับได้ ร่าง พ.ร.บ. ฉบับใหม่ที่กำลังจัดทำก็เป็นไปในเชิง ‘บังคับ’ หรือ ‘ควบคุม’ มากกว่า ‘ส่งเสริม’ การพัฒนาเมือง ซึ่งคงส่งผลให้ผังเมืองรวมไม่สามารถนำไปปฏิบัติได้เช่นเดิม แม้ว่าได้กระจายอำนาจไปสู่ท้องถิ่นแล้วก็ตาม แต่องค์กรปกครองส่วนท้องถิ่น (อปท.) ยังไม่มีความสามารถในการวางและจัดทำผังเมือง รวมทั้งไม่ดำเนินการจัดทำแผนงานและโครงการพัฒนาเมืองด้านกายภาพต่อเนื่องให้ละเอียดและลึกลงไปอีก เพื่อนำไปปฏิบัติให้เกิดการพัฒนาตามนโยบายและกรอบของผังเมือง 

        บทความนี้มีวัตถุประสงค์จะนำเสนอกรอบและแนวทางการนำแผนและผังเมืองไปปฏิบัติสำหรับหน่วยงานในองค์กรปกครองส่วนท้องถิ่นบนพื้นฐานของทฤษฎีและประสบการณ์จากหลายแหล่ง เพื่อให้แผนและผังเมืองมีส่วนนำให้เกิดการพัฒนาชุมชนเมืองทางด้านกายภาพที่เป็นระบบและระเบียบ เกิดผลกระทบในทางบวกตามเจตนารมณ์ของแผนและผังเมืองนั้นๆ โดยได้นำเสนอกรอบของการนำแผนและผังเมืองไปปฏิบัติ ซึ่งประกอบด้วยแนวทางต่างๆ ที่ อปท.ควรจะดำเนินการเริ่มตั้งแต่การจัดทำแผนและผังหลักสำหรับการนำไปปฏิบัติ หารูปแบบการบริหารจัดการและมอบหมายให้หน่วยงานต่างๆ เข้ามามีหน้าที่และส่วนรับผิดชอบโดยตรง การจัดช่วงระยะเวลาในการพัฒนาของแผนและโครงการทั้งหมดให้สอดคล้องกับการลงทุน แสวงหาแหล่งงบประมาณเพื่อนำมาใช้ในการพัฒนา การใช้กลไกควบคุมการพัฒนาด้วยมาตรการทางกฎหมาย พร้อมทั้งเลือกใช้เทคนิควิธีการและกลยุทธ์ซึ่งเป็นมาตรการทางบวกมาสนับสนุนการนำแผนและผังเมืองไปปฏิบัติ.

City Plan Implementation Framework and Guidelines for Local Administrative

        Contemporary urban planning practice in Thailand can be traced back to 1957. Despite the many years that have passed, city planning has made little progress. Starting from a comprehensive planning concept, all prepared city plans
still revolves around ‘general plan’ concepts based on City Planning Act B.E. 2518. The only distinctive works are adopted ‘General Plans’, while ‘Specific Plans’ are still on papers. However, many of these plans are now outdated and no longer
enforceable legally. New version of City Planning Act is still at the draft stage. This draft is conceptually based on ‘controlling’ instead of ‘promoting’ developments for the city, similar to the existing Act, which has unproductive outcomes. Even
though the Central Government had decentralized and delegated more authority in preparing the city plan to the Local Administrative Authority, but most LAA cannot perform the plan making task. Up to now, LAA has never proceeded further in
exploring the possible alternatives and more detailed plans for implementation under the plan’s policies and frameworks.

        Thus, the objective of this article is to propose a framework and guidelines for Local Administrative Authority in implementing the physical development plan for their respective cities based on theories and practice gathered from various
sources, in the hope that the plan can initiate an orderly and compatible physical development and eventually achieve a positive impact on the city according to the plan’s intention. The recommendation consists of guidelines that LAA should
perform such as preparing a working master plan for implementation, setting up an effective administrator and managing organization as well as delegating direct responsibility to such department. Phasing the development programs and projects
according to investment schemes and seeking capital resources for financing all developments are advised. Mechanism and measures for controlling private development utilizing local regulations along with various positive techniques, methods, and strategies are also suggested.
