ปัญหาของการได้สัญชาติไทยภายหลังการเกิด: กรณีศึกษาชาวเวียดนามอพยพ ชั้นบุตรและชั้นหลาน (The Issue of Acquiring Thai Nationality after Birth in Thailand: A Case Study of Children and Grandchildren of Vietnamese Immigrants)

Abstract

บทความนี้ได้วิเคราะห์และหาแนวทางแก้ไขปัญหาของการได้สัญชาติไทยที่ได้มาโดยการเกิดของชาวเวียดนามอพยพชั้นบุตรและชั้นหลานที่เกิดในประเทศไทย แต่ภายหลังถูกเพิกถอนสัญชาติไทยโดยผลของประกาศของคณะปฏิวัติฉบับที่ 337 และกลับมาได้สัญชาติไทยอีกครั้งหนึ่งตามกฎหมายว่าด้วยสัญชาติที่ผ่านการแก้ไขเปลี่ยนแปลง ซึ่งถือว่า แม้จะเป็นพลเมืองไทยโดยสมบูรณ์แล้วก็ตาม แต่ก็เป็นการได้รับสัญชาติไทยโดยการให้ภายหลัง มิใช่การได้สัญชาติไทยโดยการเกิดตามหลักดินแดน ส่งผลให้สูญเสียสิทธิบางประการที่ทางราชการไทยได้สงวนไว้สำหรับผู้ที่มีสัญชาติไทยโดยการเกิดเท่านั้น ผู้วิจัยได้วิเคราะห์และชี้ให้เห็นว่า สำนักงานคณะกรรมการกฤษฎีกา ได้วินิจฉัยแล้วว่า ชาวเวียดนามอพยพชั้นบุตรและชั้นหลานที่เกิดในประเทศไทย จะต้องได้รับสิทธิของการถือสัญชาติไทยโดยการเกิด The Issue of Acquiring Thai Nationality after Birth in Thailand: A Case Study of Children and Grandchildren of Vietnamese Immigrants

This article addresses the problems and solutions to the issue of the revocation of Thai nationality among the second- and third-generation Vietnamese who were born in Thailand. Their Thai nationality was revoked by the Declaration of the Revolutionary Council Number 337. They regained their Thai nationality again through an amendment of law. Since technically their nationality was nationalized, not by birth, they lost some of the rights and privileges that they once had as persons who were born in Thailand. To address and resolve this issue, the author conducted a documentary research and found that the Office of State of Thailand had ruled that since these Vietnamese were born in Thailand, their nationality would be Thai by de facto, thus their rights and privileges remained the same as people who were born in Thailand.
