The Consumer Protection in Selling and Purchasing The Mystery Box Via Online System

This research aims to study the problems and limitations of the law related to the contracts of online mystery box trading in Thailand, and to propose the guidelines for improving and resolving legal obstacles to protect the consumers under the contracts. The study found that the mystery boxes selling in Thailand has two 2 main issues: 1) the supervision of entrepreneurs in selling goods in the form of mystery boxes online in Thailand. Currently there is no law that related to the contract of selling mystery boxes via online purchases, therefore there is no controlling and supervising appropriately for consumers. 2) problems of amelioration for those who have been disadvantage from selling or purchasing products in the form of a mystery box online. The researcher had studied the solutions from the Electronic Commerce Law and Online Broadcasting Marketing Regulations of the People's Republic of China. Additionally, mystery boxes customer’s protection of Japan, which mainly about the authority and duty to consider the complaints from consumers who have suffered from the actions of the entrepreneurs. From the study, the researcher has proposed the solution of supervising the mystery boxes entrepreneurs by defining definitions, qualifications, and duties of entrepreneurs. Improve the compensation process for those damaged by buying and selling mystery boxes via online system. By improving the process for receiving complaints and the consumer mediation process before filing a lawsuit to be mandatory, not difficult, not complicated, not expensive, not time consuming, as well as promoting consumers to access the court process and use their rights to sue in litigation by themselves.
