The Offence of "Forced Labour or Services"

Abstract

The offence of forced labour or services has recently been constituted as a new criminal offence, which may cause problems in enforcement and interpretation of which employer’s acts shall be considered prohibitive acts of forced labour or services offence. In this regard, if the law enforcement does not have enough understanding of this law, an offender may be able to escape from the justice system and the victims of forced labor or service will consequently not receive support and protection by government agencies. This article aims at explaining the guidelines for enforcing and interpreting of labour or service offence as well as providing examples of forced labour indicators proposed by the International Labour Organization to serve as guidance for effective enforcement and interpretation of the law for relevant persons and government agencies.
