บทคัดย่อ

อารมณ์ (Emotions) เป็นสิ่งที่ถูกกำหนดให้เป็นคู่ตรงข้ามกับเหตุผล (Reason) ทั้งนี้ การศึกษาอารมณ์เริ่มกว้างขวางมากขึ้นโดยเฉพาะพัฒนาการในสาขาวิชาปรัชญาประยุกต์ ไม่ว่าจะเป็นรากฐานที่สำคัญของการศึกษาจิตวิทยา และอารมณ์ได้รับการขยายฐานการศึกษามาสู่สังคมวิทยา ที่เรียกว่า สังคมวิทยาอารมณ์ (Sociology of emotion) มานุษยวิทยาอารมณ์ (Anthropology of emotion) รัฐศาสตร์รวมถึงอารมณ์ในการศึกษาความสัมพันธ์ระหว่างประเทศ จึงเป็นสาเหตุให้การศึกษาอารมณ์ในทางสังคมศาสตร์ (Social science of emotion) มีความกว้างขวางอย่างมาก อย่างไรก็ตาม การศึกษาอารมณ์ควบคู่การศึกษานิติศาสตร์ซึ่งดูเสมือนจะเป็นสิ่งที่เป็นไปไม่ได้ เพราะว่าหลักการที่สำคัญที่สุดของการศึกษานิติศาสตร์คือการศึกษานิติศาสตร์ที่ประกอบไปกระบวนการในการสร้างความเป็นเหตุเป็นผล (Rationalization) โดยเฉพาะอย่างยิ่งกระบวนการนิติบัญญัติ (Legisprudence) กระบวนการยุติธรรมอันเป็นกระบวนการที่เปรียบเสมือนตัวแทนแห่งเหตุผลที่เที่ยงแท้แห่งความยุติธรรม

นิติศาสตร์แนวอารมณ์นิยม (Legal emotionalism) เป็นการนำเสนอวิธีวิทยา (Methodology) หรือมุมมองอีกประการหนึ่งในการมองกฎหมายหรือนิติศาสตร์ที่เกิดขึ้นในโลกแห่งความเป็นจริงที่โดนละเลย เพิกเฉยมาอย่างยาวนาน ทั้งที่อารมณ์ปรากฏอยู่ในทั้งกระบวนการนิติบัญญัติ การบังคับใช้กฎหมาย กระบวนการยุติธรรมรวมถึงขั้นตอนของการพิจารณาพิพากษาคดี ดังนั้น การทำความเข้าใจกระบวนการสร้างแนวความคิดของอารมณ์ในแง่ของปรัชญา คุณค่าแห่งการศึกษาอารมณ์ ความหลากหลายของอารมณ์ที่เกิดขึ้นในสังคมมนุษย์ อิทธิพลของการศึกษาอารมณ์ในทางสังคมศาสตร์ กระบวนการในการขับเคลื่อนอารมณ์ในทางนิติปรัชญา พร้อมทั้งนิติศาสตร์แนวอารมณ์นิยมได้พยายามเสนอคุณค่าของการนำมุมมองทางด้านอารมณ์มาผสมผสานกับนิติศึกษา การศึกษาอารมณ์ที่ผนวกรวมกับตัวบทกฎหมาย การศึกษาอารมณ์ในกระบวนการยุติธรรมตามหลักการประจักษ์นิยม การศึกษาอารมณ์ของกระบวนการทำงานของตุลาการ รวมถึงการศึกษาอารมณ์ในปรัชญาของกฎหมายระหว่างประเทศที่ได้หยิบยืมมาจากวิธีวิทยาการศึกษาความสัมพันธ์ระหว่างประเทศ

นิติศาสตร์แนวอารมณ์นิยมพยายามนำเสนอเครื่องมือในการวิเคราะห์นิติศาสตร์ตามนักวิชาการตะวันตกที่สำคัญ เช่น Martha Craven Nussbaum เป็นต้น ซึ่งเป็นผู้วางรากฐานการศึกษาอารมณ์ในทางนิติปรัชญา อันนำมาสู่การพัฒนาเครื่องมือในการมองนิติศาสตร์รวมถึงการศึกษาอารมณ์ในกฎหมายระหว่างประเทศ นิติศาสตร์แนวอารมณ์ได้กลบปิดช่องว่างในการศึกษานิติศาสตร์กระแสหลักที่ยึดติดอยู่กับเหตุผลมาอย่างยาวนาน โดยนับรวมเอาความไร้เหตุผลหรือสิ่งที่เรียกว่าอารมณ์เข้ามาเป็นแกนกลางในการศึกษากฎหมาย และนำมาสู่ความยุติธรรมที่คลอบคลุมในมิติที่กว้างขวาง หลากหลายและรอบด้านมากขึ้น
