Abstract

When the concession contract of mobile phone services has expired, a private company’s right to provide mobile phone services is subsequently terminated. This in turn negatively affects a large number of consumers who cannot continue to use their mobile phone services. This, therefore, is of great importance for the National Broadcasting and Telecommunications Commission (NBTC) – an independent regulatory body of Thailand taking charge of allocating and regulating frequency usage in broadcasting telecommunications and radio communication industries – to manage frequencies after the termination of the concession contract. Such crucial duty helps avoid any detrimental impacts on consumers, state and national economy as well as government agency which is the partner of concession contract as prescribed by the law. Currently, it is clear that the number of concession contracts for providing mobile phone services has initially terminated. Also, the law that grants private sectors permission to use frequency for telecommunications services has been changed from the concession system to the licensing system by way of an auction for frequency. Such transition period is therefore intriguing to study and to find out how to resolve any critical problems possibly incurred through the number of cases.
