บทคัดย่อ

การค้างชำระค่าเช่าที่ดินของชุมชนเทพารักษ์ 4 บนที่ดินการรถไฟแห่งประเทศไทย (รฟท.) ทำให้สัญญาเช่าถูกยกเลิกและผู้อยู่อาศัยสูญเสียสิทธิในที่ดิน บทความนี้มุ่งศึกษาสาเหตุของการค้างชำระและผลกระทบที่เกิดขึ้น ใช้ระเบียบวิธีวิจัยเชิงคุณภาพ โดยมีระดับการวิเคราะห์ทั้งครัวเรือนและชุมชน มีผู้ให้ข้อมูลสำคัญ 7 ราย ประกอบด้วย ผู้นำชุมชน คณะกรรมการชุมชน ตัวแทนครัวเรือนผู้เช่ารอบเก่าและรอบใหม่ รวบรวมข้อมูลจากเอกสารที่เกี่ยวข้องและการสัมภาษณ์เชิงลึก วิเคราะห์ข้อมูลแบบแก่นสาระ ผลการวิจัย พบว่า ชุมชนที่ตั้งอยู่บนที่ดิน รฟท. และทำสัญญาเช่าช่วงกับสถาบันพัฒนาองค์กรชุมชน (องค์การมหาชน) แต่ไม่สามารถชำระค่าเช่าตามกำหนดได้ ส่งผลให้สัญญาถูกยกเลิกและมีการฟ้องร้องเรียกเก็บหนี้ค้างชำระ โดยสาเหตุของการค้างชำระค่าเช่า ได้แก่ 1) อาชีพและรายได้ที่ไม่มั่นคง 2) ศักยภาพบริหารจัดการของชุมชนที่จำกัด และ 3) ระบบการจัดเก็บค่าเช่าที่ซับซ้อน โดยผลกระทบที่เกิดขึ้น คือ ความไม่มั่นคงด้านที่อยู่อาศัยจากการถูกยกเลิกสิทธิการเช่า ต่อมาเมื่อ รฟท. มอบอำนาจให้บริษัทคู่สัญญาบริหารจัดการสัญญาเช่า การบริหารจัดการมีความชัดเจนมากขึ้น ชุมชนสามารถชำระค่าเช่าและหนี้ค้างได้ตามกำหนด ฟื้นคืนสิทธิการอยู่อาศัยและสร้างความสัมพันธ์ที่ดีขึ้นระหว่างชุมชนกับ รฟท. ข้อเสนอเชิงนโยบายแนะให้หน่วยงานที่เกี่ยวข้องควรเสริมสร้างความมั่นคงของชุมชนผ่านสวัสดิการสังคมและการพัฒนาคุณภาพชีวิต พร้อมขยายการศึกษาสู่มุมมองของหน่วยงานรัฐ เอกชน และภาคประชาสังคม เพื่อให้ข้อมูลครบถ้วนสำหรับออกแบบแนวทางการแก้ปัญหาการค้างชำระค่าเช่าที่เดินอย่างมีประสิทธิภาพและยั่งยืน
