ราชอาณาจักรไทยยังคงรักษาตำแหน่งที่โดดเด่นในกลุ่มประเทศเกษตรกรรมในเอเชียตะวันออกเฉียงใต้เนื่องจากประเทศไทยมีศักยภาพในการส่งออกที่แข็งแกร่ง และด้วยความสำคัญของภาคการเกษตรนี้ การผลิตและการคุ้มครองพันธุ์พืชจึงมีความสำคัญยิ่ง ซึ่งจากความสำคัญดังกล่าว ประเทศไทยได้ออกพระราชบัญญัติคุ้มครองพันธุ์พืช พ.ศ. 2542 เพื่อตอบโจทย์ในการส่งเสริมและสนับสนุนภาคการเกษตร อย่างไรก็ตาม ความกังวลได้เกิดขึ้นเกี่ยวกับประสิทธิภาพของกฎหมายฉบับนี้ ในการตอบสนองความต้องการของทุกภาคส่วนที่เกี่ยวข้องกับการบริหารจัดการภาคการเกษตรในประเทศไทย ความไม่แน่นอนเกี่ยวกับประสิทธิภาพของระบบการคุ้มครองพันธุ์พืชของประเทศไทยนี้ ส่งผลกระทบต่อประสิทธิผลในการตอบเจตนารมณ์ของกฎหมายดังกล่าว ซึ่งบทความนี้ได้วิเคราะห์ถึงเงื่อนไขที่จำเป็นสำหรับการอนุรักษ์พันธุ์พืชใหม่ และเน้นย้ำถึงความจำเป็นในการแก้ไขเพิ่มเติมกฎหมายที่เกี่ยวข้องในปัจจุบัน เพื่อรับประกันการดำเนินการอย่างมีประสิทธิผลของพระราชบัญญัติคุ้มครองพันธุ์พืช พ.ศ.2542
