Guidelines for labor management and termination in private sector establishments under the framework of Thai labor law

Abstract
This research on labor management and termination management in private enterprises under the framework of Thai labor law aims to (1) analyze the Thai labor law framework related to termination, (2) study labor management models and approaches that reduce the need for unfair termination, and (3) propose guidelines for managing termination cases in a legal and efficient manner. This qualitative research examined documents related to concepts and theories on labor management and termination management in private enterprises under the framework of Thai labor law. The data was analyzed in terms of content. The results showed that Thai labor law, in particular the Labor Protection Act B.E. 2541 (1998), is an important mechanism for defining the rights and duties of employers and employees, as well as measures to protect workers from unfair termination. Meanwhile, strategic labor management approaches, such as human resource planning, reskilling, and ethical labor management, can reduce the need for termination and promote good relationships within the organization. Furthermore, proper and fair termination management, such as advance notice, appeal rights, and humane separation, can help organizations maintain their image and credibility. and a sustainable balance between efficiency and social justice
