Development of the consumer case management system

Abstract

Although the Consumer Procedure Act BE 2551 has been enforced for a long time, the purpose to make the standard for consumer protection has not been accomplished in accordance with the provisions of the law because there is not any consumer case management approach that was particularly formed. According to a study of problem and case management analysis in the United States, England, France, Federal Republic of Germany and Japan compared with in Thailand by focusing on case processing and management lead to the result of the 7 elements of the effective consumer case management as follows: 1) Alternative dispute resolution 2) Classification 3) Controlling the case from the beginning and tracking the progress 4) Setting the length of the trial depending upon the type of each case. 5) Altering the proactive role of the judge. 6) Configuration of the informal trial and 7) Applying technology in the trial. This can be a guideline for the court of justice and those who involved in the consumer case management to use to manage the case productively.
