Legal problems on Enforcement of the Land Traffic Act B.E.2522: A Case Study of Emergency Patient Transport

Abstract
The objectives of this research were to study the background, concepts, and theories related to the issues and enforcement of the Land Traffic Act B.E. 2522 (1979) in cases involving the transport of emergency patients to examine legal measures regarding the enforcement of the Land Traffic Act B.E. 2522 (1979) in emergency patient transport cases in Thailand and compare them with those of other countries to analyze legal issues related to propose solutions for the enforcement challenges of the Land Traffic Act B.E. 2522 (1979) in emergency patient transport cases. This qualitative research was conducted through the study and collection of legal information, academic articles, journals, research papers, theses, statutes, as well as reliable and easily accessible online sources. The findings revealed that in legal terms, the definition of "emergency vehicle" in Thailand is wide resulting in its coverage extending to vehicles unrelated to actual emergency situations, and the penalties for drivers obstructing emergency vehicles are less strict if compared to other countries. Thailand lacks specific standards for emergency vehicle driver licenses, which may affect safety and operational efficiency. Moreover, there are no measures to enhance the efficiency of emergency patient transport which is not similar to other counties which have established specific standards for emergency vehicle driver licenses and effective measures to enhance the transport of emergency patients The proposed recommendations include amending the Traffic Act B.E. 2522 (1979) to revise the definition and penalties associated with emergency vehicles, introducing a specialized license for operating emergency vehicles, and implementing measures to enhance the efficiency of emergency patient transport in a manner that is appropriate and effective.
