Abstract

The objectives of this research were: 1. To study the criminal liability of monks. 2. To study the monks' liability according to the Dharma and Discipline 3. To compare the criminal liability and liability according to the discipline of the monks, and 4. To suggest solutions to improve criminal liability. And the discipline of the monks, which is qualitative research from the document.

The research results showed that 1. According to the Criminal Code applicable to monks, Likewise, persons residing in the Kingdom of Thailand. Criminal liability is intentional acts. And acting offense of receiving thieves recklessly has external components acquired from the commission of an offense, and the inside is the intent when someone blames. There will be a preliminary hearing according to the criminal proceedings. 2. Buddha's provisions apply only to monks, and the Tripitaka Has set out seven theft stories, saying that they must be penalized with parajik. 3. Comparison of criminal liability and liability according to the discipline of the monks in terms of criminal liability 1. Applies to persons residing in the Kingdom of Thailand appointed by many agencies 4. When accusing, the monk must feel it immediately. 4. Punishment for wrongdoing If the result of the investigation is found guilty, then he must go to jail. Or both imprisonment and fine as specified. 5. Investigation results, if there is no offense and the accused monk has yet to say a word, still considered a monk 4. Propose solutions and improvements 1. Increase the penalty for those who bring thieves as offerings. 2. Add laws in the part of Dharma 1. Repeal or amend Section 29 of the accused monks. The investigating officer shall be able to arrange for the monks to renounce their monastic sex. It is for the accused through the investigation process according to the Dharma and Vinaya completed first.
