Abstract

This research article aimed to: 1. examine legal problems concerning the treatment and rehabilitation of persons with drug dependence under the Narcotics Code B.E. 2564 (2021); 2. comparatively study the laws concerning the treatment and rehabilitation of persons with drug dependence in Thailand and foreign countries; and 3. propose guidelines for amending and improving the laws concerning the treatment and rehabilitation of persons with drug dependence under the Narcotics Code B.E. 2564 (2021). This qualitative research employed documentary research and in-depth interviews with 13 key informants. Data were analyzed using content analysis and comparative legal analysis.

The findings revealed that: 1. the legal problems concerning the treatment and rehabilitation of persons with drug dependence under the Narcotics Code B.E. 2564 (2021) included a treatment system emphasizing voluntary participation, which was insufficient to accommodate persons with drug dependence who were unwilling to enter treatment; discretion in the screening process without sufficiently clear and uniform criteria and guidelines; limitations on the authority and responsibilities of officials in controlling and supervising persons undergoing treatment; the lack of enforceable measures in cases of non-compliance with conditions or absconding; and problems concerning inter-agency integration and continuous follow-up of persons who had completed treatment. 2. The comparative study of laws concerning the treatment and rehabilitation of persons with drug dependence in Thailand and foreign countries found that the United States, the Federal Republic of Germany, the Republic of Singapore, and Malaysia had legal mechanisms integrating treatment with legal measures, supervision, and follow-up of persons undergoing treatment, with different forms and levels of enforcement according to the context of each country; and 3. Guidelines for amending and improving the law should include developing an integrated treatment system combining appropriate voluntary and compulsory measures; establishing clear standards for screening, the exercise of discretion, and the roles and authorities of relevant agencies in accordance with their missions; and developing an integrated system of supervision and follow-up from screening, treatment, and rehabilitation through post-treatment follow-up, in order to enhance the effectiveness of law enforcement and ensure continuity in the rehabilitation of persons with drug dependence.
