Legal Problems Related to Natural Resource and Environmental Management: A Case Study of Gold Mining in Contiguous Areas of Phichit, Phetchabun and Noen Maprang Districts, Phitsanulok Province

Abstract

The purpose of the research is to study the legal problems of natural resources and environmental management of gold mine in the contiguous area of Phichit, Phetcapun and Noen Maprang District in Phitsanulok. The study found that the provisions in the Minerals Act B.E. 2560 are not in accordance with the Constitution of the Kingdom of Thailand B.E.2560, as the Constitution states clearly states that natural resources, biodiversity and environment shall be developed sustainably. However, the gold mining area allowed under the Minerals Act used a huge amount rai and destroy natural resources, biodiversity and environment in the areas, which are inconsistent with the purpose of the Constitution. The research suggests that; (1) The provisions in the Minerals Act B.E.2560 should be amend in accordance with the Constitution. (2) The gold mining should be allowed when these conditions are met which are; The gold mining should done by the state for public interest, the area for gold mining should not be rich of biodiversity and natural resources and should not be the area that people have lived for long time.
