ปัญหากฎหมายเกี่ยวกับการบริหารจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อม: กรณีศึกษาการทำเหมืองแร่ทองคำในพื้นที่ติดต่อกันของจังหวัดพิจิตร เพชรบูรณ์ และอำเภอเนินมะปราง จังหวัดพิษณุโลก

บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาปัญหากฎหมายเกี่ยวกับการบริหารจัดการทรัพยากรธรรมชาติและสิ่งแวดล้อมในกรณีการทำเหมืองแร่ทองคำในพื้นที่ติดต่อกันของจังหวัดพิจิตร เพชรบูรณ์ และอำเภอเนินมะปราง จังหวัดพิษณุโลก จากการศึกษาพบว่าพระราชบัญญัติแร่ พ.ศ.2560 มีบทบัญญัติที่ไม่สอดคล้องกับรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 เนื่องจากกฎหมายรัฐธรรมนูญฉบับปัจจุบันบัญญัติให้มีการพัฒนาทรัพยากรธรรมชาติและสิ่งแวดล้อมอย่างยั่งยืน อย่างไรก็ดี การอนุญาตให้ทำเหมืองแร่ภายใต้พระราชบัญญัติแร่ฉบับนี้ มีการใช้พื้นที่จำนวนมากและก่อให้เกิดการทำลายทรัพยากรธรรมชาติและสิ่งแวดล้อมในพื้นที่ดังกล่าว อันเป็นการกระทำที่ขัดรัฐธรรมนูญ บทความวิจัยฉบับนี้ จึงมีข้อเสนอแนะ คือ (1) ควรมีการแก้ไขบทบัญญัติของพระราชบัญญัติแร่ให้สอดคล้องรัฐธรรมนูญฉบับปัจจุบัน (2) การอนุญาตให้ทำเหมืองแร่ทองคำควรจะต้องมีเงื่อนไขดังนี้ คือ การอนุญาตจะมีขึ้นได้ต่อเมื่อการทำเหมืองแร่ทองคำต้องทำโดยหน่วยงานของรัฐเองเพื่อประโยชน์สาธารณะ การทำเหมืองแร่ทองคำจะต้องไม่อยู่ในพื้นที่ที่มีความสมบูรณ์ของทรัพยากรธรรมชาติและความหลากหลายทางชีวภาพ และจะต้องมิใช่พื้นที่ที่มีประชาชนอาศัยอยู่มาเป็นเวลานาน
