แนวทางและมาตรการที่เกี่ยวข้องกับการประกันภัยเพื่อคุ้มครองนักท่องเที่ยวอวกาศของประเทศไทย

บทคัดย่อ
การท่องเที่ยวอวกาศ ถือได้ว่าเป็นภาคส่วนหนึ่งของเศรษฐกิจอวกาศใหม่ ที่ปัจจุบันได้รับความสนใจเป็นอย่างมากในสังคมโลก อย่างไรก็ตาม ธุรกิจการท่องเที่ยวอวกาศนี้ยังคงมีความเสี่ยงภัยสูงในทุกขั้นตอน ดังนั้น เห็นควรต้องมีการศึกษาวิจัยเกี่ยวกับการจัดทำประกันภัยนักท่องเที่ยวอวกาศขึ้น เพื่อลดความเสี่ยงภัยที่อาจเกิดขึ้นได้ ผลการศึกษาในปัจจุบัน พบว่า คำนิยาม แนวคิด ทฤษฎี และหลักการด้านประกันภัยที่มีอยู่สามารถนำมาปรับใช้ในการจัดทำประกันภัยนักท่องเที่ยวอวกาศได้ แต่ทว่าสังคมโลกยังคงไม่มีความชัดเจนเกี่ยวกับมาตรการด้านการประกันภัยเพื่อรองรับความเสี่ยงภัยของนักท่องเที่ยวอวกาศ รวมทั้งกฎหมายอวกาศภายในและ/หรือแนวปฏิบัติภายในของประเทศสหรัฐอเมริกา สหราชอาณาจักร สาธารณรัฐเกาหลี (เกาหลีใต้) และประเทศไทย ไม่ได้มีการกำหนดให้ต้องมีการจัดทำประกันภัยสำหรับนักท่องเที่ยวอวกาศไว้ นอกจากนี้ ด้านธุรกิจประกันภัยของประเทศไทย พบว่า ไม่มีนโยบาย กฎหมาย และทางปฏิบัติที่เกี่ยวกับการคุ้มครองนักท่องเที่ยวอวกาศอย่างชัดเจน ดังนั้น เห็นควรเสนอแนวทางและมาตรการต่อประเทศไทยเพื่อแก้ไขปัญหาข้างต้น ดังนี้ (1) นโยบายและกฎหมายอวกาศของประเทศไทยควรดำเนินการจัดทำ และ/หรือ แก้ไขปรับปรุงให้มีความชัดเจนและต่อเนื่อง (2) ดำเนินการส่งเสริมให้เกิดการคุ้มครองนักท่องเที่ยวอวกาศ (3) ส่งเสริมให้มีการจัดทำกรมธรรม์ประกันภัยนักท่องเที่ยวอวกาศขึ้นโดยเฉพาะ และ (4) ควรมีการดำเนินการอื่นใดที่เกี่ยวข้องกับการท่องเที่ยวอวกาศ เช่น การจัดทำฐานข้อมูลทางสถิติเกี่ยวกับความเสี่ยงภัย เป็นต้น
