บทคัดย่อ
การกรูมมิ่งเด็ก (Child Grooming) เป็นกลวิธีของการล่วงละเมิดทางเพศต่อเด็ก
รูปแบบหนึ่งซึ่งเป็นกระบวนการที่ผู้กระทำเตรียมเด็กสำหรับการแสวงหาผลประโยชน์ทางเพศ
จากเด็กหรือเพื่อให้เด็กสนองความใคร่ตนเอง การกรูมมิ่งเด็กส่วนใหญ่เกิดขึ้นในลักษณะของการก่อความสัมพันธ์ใกล้ชิดกับเด็ก เพื่อให้เด็กมอบความไว้วางใจและไว้เนื้อเชื่อใจแก่ผู้กระทำแล้วจึงกระทำทางเพศหรือแสวงหาผลประโยชน์ทางเพศจากเด็กในภายหลัง
การติดต่อสื่อสารผ่านช่องทางออนไลน์ถูกนำมาใช้ในการกรูมมิ่งเด็กจำนวนมาก ซึ่งเป็นช่องทาง
ติดต่อสื่อสารที่ทำให้ผู้กระทำมีโอกาสในการเข้าถึงเด็กได้โดยตรงและสามารถกรูมมิ่งเด็กได้
ในปริมาณมาก การให้ความคุ้มครองทางกฎหมายของไทยในปัจจุบันยังไม่สามารถให้
ความคุ้มครองเด็กจากการถูกกรูมมิ่งเพื่อกระทำทางเพศต่อเด็กได้โดยตรง การบังคับใช้บทบัญญัติที่มีในกฎหมายปัจจุบันจึงเป็นเพียงการปรับใช้บทบัญญัติกับข้อเท็จจริงภายหลังการกรูมมิ่งเด็กสำเร็จแล้ว ซึ่งเป็นการลงโทษการกระทำความผิดสำเร็จมากกว่าการจัดการกับการกรูมมิ่งเด็กหรือการแสวงหาผลประโยชน์จากความไว้วางใจอันเกิดจากการกรูมมิ่งเด็ก นอกจากนี้โทษทางอาญาของบทบัญญัติที่นำมาปรับใช้เทียบเคียงกับกรณีการกรูมมิ่งเด็กผ่านช่องทางออนไลน์มีอัตราโทษทางอาญาที่เบากว่าความผิดเกี่ยวกับการกระทำทางเพศต่อเด็ก ดังนั้น ผู้เขียนจึงมีข้อเสนอแนะให้ควรมีการกำหนดความผิดอาญาเกี่ยวกับการกรูมมิ่งเด็กหรือการตระเตรียมกระทำทางเพศต่อเด็กต่อเนื่องจากการกรูมมิ่งเด็ก เพื่อยับยั้งไม่ให้ผู้กระทำสามารถกระทำความผิดทางเพศต่อเด็กสำเร็จ และควรมีการกำหนดความผิดเกี่ยวกับการแสวงหาผลประโยชน์ทางเพศจากเด็กผ่านช่องทางออนไลน์ ซึ่งเป็นการกระทำที่มักเกิดขึ้นภายหลังจากการกรูมมิ่งเด็กผ่านช่องทางออนไลน์
