Abstract

In the past decade, The Two Constitutions of The Kingdom of Thailand (promulgated in B.E. 2540 and B.E. 2550) cause several problems in Legislative, Executive and Judicative systems. The Constitution B.E. 2540 was fabricated by a political reform idea. The amendment was created the


independent organizations which proved and supervised functions of Legislative and Executive powers.


The election commission of Thailand is one of the independent organizations, which has various obligations. In the Separation of power theory, the election commission of Thailand has problems in performing its tasks by lacking of check and balance power on itself. In the constitution B.E. 2550, the same problem still remains.


The author explains to, the election commission of Thailand has tasks in Legislative, Executive or Judicative power. And the powers concern to problem of the jurisdiction of the court and balance of powers that involve the problem of individual rights.
