บทคัดย่อ
บทความฉบับนี้มีวัตถุประสงค์เพื่อนำเสนอองค์ความรู้เชิงกฎหมายเกี่ยวกับสินค้าที่ใช้ได้สองทาง (Dual-Use Items: DUI) ซึ่งเป็นสินค้าที่มีคุณสมบัติในการนำไปใช้ทั้งในกิจการพลเรือนและกิจการทางทหาร อันอาจนำไปสู่ความเสี่ยงต่อการแพร่ขยายอาวุธที่มีอานุภาพทำลายล้างสูง โดยศึกษาผ่านกรอบความตกลงระหว่างประเทศ ได้แก่ ข้อมติคณะมนตรีความมั่นคงแห่งสหประชาชาติที่ 1540 (United Nations Security Council Resolution 1540: UNSCR 1540) กฎระเบียบของสหภาพยุโรปว่าด้วยการควบคุมการส่งออกสินค้าที่ใช้ได้สองทาง (EU Dual-Use Regulation) และบทบัญญัติแห่งกฎหมายของประเทศต่าง ๆ ที่เป็นแนวทางในการดำเนินมาตรการควบคุม เช่น สหรัฐอเมริกา ญี่ปุ่น และสาธารณรัฐเกาหลี เพื่อนำมาวิเคราะห์กับกรอบกฎหมายและแนวนโยบายของประเทศไทย ซึ่งปัจจุบันอยู่ระหว่างการพัฒนาระบบการควบคุมให้สอดรับกับมาตรฐานสากล
ผลการศึกษาชี้ให้เห็นถึงความจำเป็นของการจัดทำกลไกทางกฎหมายและการบริหารจัดการภาครัฐที่มีประสิทธิภาพ โดยเฉพาะการมีส่วนร่วมของภาคเอกชนในฐานะผู้ส่งออกสินค้าและเทคโนโลยีที่มีความอ่อนไหว เพื่อให้สอดคล้องกับพันธกรณีระหว่างประเทศ เสริมสร้างความมั่นคงของรัฐในมิติทางยุทธศาสตร์ และในเชิงพาณิชย์เพื่อการส่งออกสินค้าอย่างปลอดภัย ทั้งนี้ บทความเสนอข้อพิจารณาทางนโยบายเพื่อการวางรากฐานด้านกฎหมาย มาตรการกำกับดูแล และนวัตกรรมบริการภาครัฐ เพื่อขับเคลื่อนกลไกการควบคุมสินค้าที่ใช้ได้สองทางในประเทศไทยอย่างเป็นระบบและยั่งยืน
