The Appropriateness of Local Government Organizations of the Kingdom of Thailand and Mediation according to the Dispute Mediation Act B.E. 2562 (2019): A case study of the Republic of the Philippines and the People's Democratic Republic of Laos

Abstract

The aim of this article is to study the theoretical concepts, background and principles related to legal assistance issues regarding dispute resolution by mediation which is considered as a method to provide public justice administration in the justice process apart from litigation in the court. In other words, it is considered as an alternative justice process to resolve disputes in the settlement under the Dispute Mediation Act B.E. 2562 (2019). This study was implemented by a comparative study of mediation of the Republic of the Philippines and the People's Democratic Republic of Laos that it was the study from the countries in ASEAN region which was not much different from the Kingdom of Thailand. In addition, these countries also have community justice system with mediation at the community level and legislative level.

According to the study, it was found that local government organizations have not been determined as state agencies that have the authority under the Dispute Mediation Act B.E. 2562 (2019). The local government organizations are the institutions located in the area at sub-district level, and there are 7,852 local government organizations at present which receive the status of a juristic person that they have close relationship with the people in the area. Furthermore, the executive is the president of the local government organization, and the local council members are elected directly from the people that they have understanding of the problems and local context in the area. The local government organizations are another government agencies that are ready to play a part in promoting and supporting dispute mediation through the participation of the people. Therefore, the fact that the authority of the local government organizations has not been assigned will have resulted in the incomplete dimension of the justice administration in the alternative justice process, and it may be an obstruction in the legal assistance.
