บทคัดย่อ

บทความนี้มีวัตถุประสงค์เพื่อศึกษาและแสวงหาแนวทางการแก้ไขปัญหากรณีนายจ้างไม่จ่ายชดเชยมื่อสิ้นสุดสัญญาจ้างและไม่สามารถบังคับคดีได้ โดยในสภาพสังคมปัจจุบันภายหลังจากมีเหตุการณ์โรคระบาดไวรัสโคโรนา (COVID-19) ที่ก่อให้เกิดผลกระทบกับทุกภาคส่วนทั้งภาคธุรกิจและภาคอุตสาหกรรม ส่งผลให้กิจการ ธุรกิจ และสถานประกอบการหลายแห่งจะต้องประสบปัญหาทางเศรษฐกิจที่เกิดขึ้น นายจ้างไม่สามารถจะแบกรับภาระที่เกิดขึ้นไหว จึงตัดสินใจปิดกิจการลง ต่อมาเมื่อได้ปิดกิจการไปแล้ว นายจ้างจะมีหน้าที่ตามกฎหมายในการจ่ายเงินต่าง ๆ ให้แก่ลูกจ้างที่มีสิทธิได้รับเงินตามกฎหมาย โดยในปัญหานี้จะกล่าวถึง เงินค่าชดเชย ตามกฎหมายคุ้มครองแรงงานที่ลูกจ้างมีสิทธิได้รับหากนายจ้างบอกเลิกสัญญาจ้างแล้ว แต่ปัญหาที่เกิดขึ้นจะเป็นกรณีที่นายจ้างมีเจตนาหลบหนีการจ่ายค่าชดเชย โดยเจตนาปล่อยลูกจ้างลอยแพ ทิ้งภาระไว้ให้รัฐเป็นผู้จัดการให้ความช่วยเหลือบรรเทาความเดือดร้อนของลูกจ้างดังกล่าว หรืออีกกรณีหนึ่งที่นายจ้างไม่มีเจตนาหลบหนีการจ่ายค่าชดเชย แต่นายจ้างไม่มีทรัพย์สินอื่นใดเหลืออยู่เพียงพอที่จะจ่ายค่าชดเชยให้แก่ลูกจ้าง แม้ว่าจะดำเนินคดีตามกฎหมายไปถึงขั้นบังคับคดีแล้วนั้น แต่นายจ้างก็ไม่มีทรัพย์สินใด ๆ มาจ่ายค่าชดเชยให้แก่ลูกจ้างได้
