Role of the National Sports Tribunal in the Australian Sport Justice

This paper focuses on the role of the National Sports Tribunal (NST) in the Australian sport justice, and its positive effect on regulatory functions for protecting sports participants against unfair practices and giving sports stakeholders’ additional rights in respect of good practices in sports proceeding for maintaining more fairness and integrity in sports. It also focuses on functions of the NST in the field of independent, effective and efficient dispute resolution services to sporting governing bodies, athletes and all relevant sports participants. It outlines the background to the National Sports Tribunal Act 2019 and considers the sports dispute resolution provisions found in the Act. It particularly looks at the rights of access to sports justice and considers how the Act treats unfair terms in Australian sports. This paper analyses a number of legal challenges related to consideration of using an alternative dispute resolution service under the Act.
