บทคัดย่อ

บทความฉบับนี้มุ่งศึกษาบทบาทของคณะกรรมการวินิจฉัยข้อพิพาททางการกีฬาในกระบวนการยุติธรรมทางการกีฬาของประเทศออสเตรเลีย รวมทั้งผลกระทบในด้านบวกจากกลไกปกป้องผู้ร่วมกิจกรรมกีฬาจากการกระทำที่ไม่เป็นธรรมกับการให้สิทธิแก่ผู้มีส่วนได้ส่วนเสียในวงการกีฬาที่จะได้รับการปฏิบัติที่ดีในกระบวนการยุติธรรมทางการกีฬาเพื่อดำรงรักษาความเป็นธรรมและความถูกต้องชอบธรรมในวงการกีฬา บทความฉบับนี้ยังศึกษากลไกการทำงานของคณะกรรมการวินิจฉัยชี้ขาดข้อพิพาททางการกีฬา ซึ่งทำงานด้วยความเป็นอิสระ มีประสิทธิภาพและมีศักยภาพในการระงับข้อพิพาทระหว่างบรรดาองค์กรบริหารปกครองกีฬา นักกีฬาและบรรดาผู้เกี่ยวข้องสัมพันธ์กับวงการกีฬา บทความฉบับนี้ยังกล่าวถึงพระราชบัญญัติคณะกรรมการวินิจฉัยข้อพิพาททางการกีฬาแห่งชาติ ค.ศ. 2019 และพิจารณาเนื้อหาของพระราชบัญญัติฉบับนี้ บทความฉบับนี้ยังมุ่งศึกษาสิทธิในการเข้าถึงกระบวนการยุติธรรมทางการกีฬา พร้อมกับว่ากฎหมายฉบับนี้ได้มีส่วนช่วยขจัดความไม่เป็นธรรมในวงการกีฬาออสเตรเลีย บทความฉบับนี้วิเคราะห์ประเด็นความท้าทายในการใช้กระบวนการยุติธรรมทางเลือกภายใต้กฎหมายฉบับนี้
