Abstract

The objective of this academic article is to study and analyses the type of project and the checking for the practice in compliance with the approved environmental impact assessment report. From the study, it is found that the National Environment Quality Promotion and Protection Act B.E. 2535 and the Notification of the Ministry of Natural Resource and Environment on the project, business or the operation that the environmental impact assessment report must be prepared has determined the size of project that must be mainly reported without focusing on the type of project that has caused the law avoidance problem for not preparing the environmental impact assessment effect assessment report and that the environmental protection is ineffective. In addition, the environmental impact report has been approved by the government section unit and there is no any law and governmental units to check the practice in compliance with the environmental impact report as the office of the Natural Resources and Environmental Policy and Planning has the authority to approve the report only. From such problem it is deemed expedient to recommend that if the law and regulations of the office of the Natural Resources and Environmental Policy and Planning must be amended, the type should be determined without limiting the size of the project and the office of the Natural Resources and Environment at Policy and Planning shall have the authority to stop or cancel the project failing to comply with the approved environmental impact report in order to make the administration and environmental protection to be more effective.
