Conflict Resolution through the Restorative Justice and Peaceful Resettlement by Thai Law Enforcement Authorities

Abstract

This research study shows the findings about “the Conflict Resolution through the Restorative Justice and Peaceful Resettlement by Thai law enforcement and legal authorities”. This application for restorative justice and peaceful conflict resolution is in line with the national strategy (2018 - 2037) that promotes an alternative justice system, community justice, and public participation in the justice system. In addition to the strategic plan, the application is also settled in according to the 2017-2020 National Reconciliation Strategic Plan which emphasizes the role of restorative justice and peaceful resettlement. The objective of this research is to study the relevant laws and regulations, patterns and mechanisms of conflict resolution, methods, and appropriate conflict management models in enhancing reconciliation through peaceful conflict management under the operation of law enforcement agencies and legal authorities throughout the country both in the central and provincial areas. The results of the study found that (1) the prosecutor should participate more in the community mediation; (2) The police should do more in the mediation process prior to the case being accepted into a lawsuit or entering the case to the criminal justice; (3) The village committee should be another active actor for mediation who works together with the Damrongtham District Center of the  Ministry of Interior in provincial and non-urban areas; (4) the Community Justice Center by the Ministry of Justice should hold more legal authorities in conflict resolution and dispute mediation according to the new law come out to support their operation; and (5) the Right and Liberties Protection Department should enhance the coverage and the number of regulated mediator through the role of the community dispute mediation center under the Conciliation Act B.E. 2562 (2019).
