การใช้ประโยชน์จากแสงสว่างโดยคำนึงถึงสิ่งแวดล้อมถูกนำมากำหนดและวางหลักเกณฑ์โดยสมาคมพลังงานและองค์กรรณรงค์เกี่ยวกับสิ่งแวดล้อมสรรค์สร้างหลายองค์กรเพื่อเพิ่มคุณภาพการออกแบบชุมชนเมือง สถาปัตยกรรมและการพัฒนาเมืองในประเทศอังกฤษ หลายสมาคมพลังงานและองค์กรรณรงค์เกี่ยวกับการใช้แสงสว่างอย่างถูกวิธีในประเทศอังกฤษ ยังได้พยายามเชิญชวนให้ประชาชน ภาคเอกชนและภาครัฐปฏิบัติตามมาตรฐานขั้นต่ำที่สมาคมพลังงานและองค์กรรณรงค์เกี่ยวกับการใช้แสงสว่างในประเทศอังกฤษได้วางหลักเกณฑ์เอาไว้ เพื่อให้เกิดความมั่นใจในการใช้แสงสว่างของสิ่งแวดล้อมสรรค์สร้างอย่างถูกวิธี อย่างไรก็ดี องค์กรของรัฐ และองค์กรปกครองส่วนท้องถิ่นของประเทศอังกฤษกลับไม่ได้กำหนดเกณฑ์โดยอาศัยมาตรการทางกฎหมายที่กำหนดวิธีการการใช้แสงสว่างอย่างถูกวิธีและการควบคุมมลภาวะทางแสง แม้ว่าความวิตกในเรื่องมลภาวะทางแสงได้นำไปสู่การพัฒนาเทคโนโลยีแสงสว่างและการใช้แสงสว่างแบบใหม่หลายประการ อย่างไรก็ตาม กฎหมายสิ่งแวดล้อมและผังเมืองของประเทศอังกฤษก็ยังไม่ได้กำหนดชัดเจนเกี่ยวกับหลักเกณฑ์และวิธีการในการควบคุมมลภาวะทางแสงแต่ประการใด ด้วยเหตุนี้ หลักเกณฑ์และวิธีการในการควบคุมมลภาวะทางแสงจึงควรถูกนำมาบัญญัติไว้ในกฎหมายสิ่งแวดล้อมสำหรับการพัฒนาสิ่งแวดล้อมสรรค์สร้าง อนึ่ง มลภาวะทางแสงก่อให้เกิดผลกระทบที่สำคัญหลายประการสำหรับการพัฒนาสิ่งแวดล้อมสรรค์สร้างผ่านผลกระทบต่อสิ่งแวดล้อมในทางลบ ดังนั้น กฎหมายสิ่งแวดล้อมและข้อบังคับที่เกี่ยวข้องในประเทศอังกฤษจึงควรได้รับการปรับปรุงและพัฒนาเพื่อรองรับการพัฒนาสิ่งแวลดล้อมสรรค์สร้างและปัญหาคุณภาพของแสง บทความทางวิชาการฉบับนี้จึงอภิปรายเกี่ยวกับหลักการด้านมลภาวะในประเทศอังกฤษ โดยมุ่งเฉพาะในการอภิปรายในประเด็นของการควบคุมมลภาวะทางแสงและการสร้างมาตรฐานการใช้งานแสงสว่างโดยกฎหมายสิ่งแวดล้อมสำหรับการพัฒนาสิ่งแวดล้อมสร้างสรรค์ในประเทศอังกฤษ

Abstract

The environmental lighting practices are being required by energy associations and lighting governing bodies in order to increase the quality contemporary urban design, architecture and development in the UK. To ensure lighting governance of the built and environment, the energy associations and lighting governing bodies is also anticipated that people, private sectors and public sectors will take environmental responsibilities at minimum level of the lighting design regulatory framework. However, there is no increasing recognition of the lighting governance and light pollution control by the public sectors and local authorities. Light pollution concern has led to the development of new lighting technologies and practices; nevertheless the UK’s environmental and planning legislation cannot be clearer and more consistent. Light pollution problems currently presents public sectors, industrial sectors, business sectors and people with are in large part built environment and lighting design problems. As a result, light pollution control, lighting governance and built environment should be essential parts of environmental law for the built environment. Light pollution has made significant impacts on the built environment development due to their negative environmental effects, environmental law and regulations therefore should be developed and adopted, which supports build environment development and lighting quality awareness. This paper will discuss and investigate wide ranging implications on light pollution aspects in the UK. The focus will be on light pollution control and lighting standardization by environmental law for the built environment development in the UK.
