บทคัดย่อ

การอนุรักษ์ย่านสำคัญทางประวัติศาสตร์เป็นการป้องกันกลุ่มอาคารที่มีคุณค่าทางประวัติศาสตร์และวัฒนธรรม จากการถูกรุกล้ำหรือทำลายโดยการขยายตัวของเมือง รวมทั้งส่งเสริมลักษณะเด่นทางวัฒนธรรมของเมือง ดังที่ได้ปฏิบัติกันมาในหลายๆ ชุมชนในประเทศสหรัฐอเมริกา หากแต่การอนุรักษ์พื้นที่เกี่ยวข้องกับผู้คนจำนวนมากซึ่งมีความต้องการแตกต่างกัน และเกี่ยวข้องกับการใช้มาตรการทางกฎหมายจำกัดสิทธิ์การใช้งาน ทำให้หลักเกณฑ์ต่างๆ ในการคัดเลือกย่านประวัติศาสตร์และกำหนดขอบเขตย่านเป็นประเด็นถกเถียงและวิพากษ์วิจารณ์มานาน จากนักวิชาการด้านประวัติศาสตร์ โบราณคดี อนุรักษ์ ประชาชนทั่วไปและนักการเมือง บทความนี้จึงนำเสนอถึงประเด็นต่างๆ ในการจัดตั้งย่านประวัติศาสตร์หนึ่งๆ เริ่มจากหลักเกณฑ์ในการคัดเลือกย่านประวัติศาสตร์ การกำหนดขอบเขตของย่านประวัติศาสตร์ ประเด็นต่างๆ ทางด้านกฎหมายในการกำหนดย่านประวัติศาสตร์ เช่น การใช้มาตรการทางกฎหมายเพื่อปกป้องย่านประวัติศาสตร์และมรดกทางวัฒนธรรมจากการถูกดัดแปลง กรรมสิทธิ์ของเจ้าของอาคาร ผลกระทบทางเศรษฐกิจต่อเจ้าของอาคารและชุมชนในท้องถิ่น รวมทั้งนโยบายของภาครัฐต่อการอนุรักษ์ ตอนท้ายของบทความนี้ ผู้เขียนได้นำเสนอแนวทางการอนุรักษ์ย่านประวัติศาสตร์ในระดับท้องถิ่นที่ส่งเสริมการรับรู้ต่อสถานที่ในย่านนั้น

Abstract

The creation of a historic district is to protect cultural and historical value of buildings in the historic area from demolition caused by urban growth. It also promotes the distinctive cultural character of the cities as practiced in many communities in the United States. Since the designation of historical districts finds different expressions among different people and involves the law enforcement in placing restrictions on the uses of property, establishing criteria for historic district selection and boundary decisions has long been discussed and criticized by academics such as historians, archeologists and conservationists, as well as the public and politicians. This article presents issues raised in creating a historic district. It reviews criteria for historic district selection and boundary delineation, as well as issues related to legal defensibility in protecting historical areas including the law enforcement, rights of property owners, economic impact and conservation policies. Finally, it recommends the approaches to successfully achieve local conservation and enhance the sense of place in such district.
