The Studies on Compare of Legal Measures on the Advantages Control of Cannabis

Abstract
This research study aims to study the legal status of cannabis, and the legal measures on the control of the advantages of the plant in Thailand. The study also tends to compare the legal measures on the advantages control of cannabis between Thailand and other countries. The legal measures on cannabis from other countries such as were studied and compared to the legal measures in Thailand. The qualitative data were analyzed using the documentary research method. The results suggested that 1) for the legal status, cannabis is deemed as a hard drug according to the Narcotic Drugs Act, B.E. 2522. However, if it was used under the restricted condition or as the medical means or for the research studies in medical fields, the act was considered as the legal one or their guilt and penalty would be mitigated based on the law of the advantages of the plant. The one who used the drug would not be accused with the criminal charges as the act did not completely fulfil the condition of the act of crime, and it was not deemed as the opprobrious crime; 2) for the legal measures on the advantages control of cannabis in other countries, it found that in America, Germany and French cannabis was allowed to be used in the medical fields and for the research studies. In some cities of Australia, they allowed cannabis to be used for the patients who entered the last stage of their life. Netherlands, Portugal, and Canada allowed their people to consume and own cannabis with a very limited amount of it.
