A Study and Analysis of the Assisted Reproductive Technology: Within Living Couples Scenario

Abstract
Abstract This Research aims for the study of the Assisted Reproductive Technologies in Thailand and other countries. Contains the legal problems and improvements of the application of the Child Born via Assisted Reproductive Technologies Protection Act B.E.2558. According to the study, the legislative of the Federal Republic of Germany, Republic of France, Australia, Republic of India and the United Kingdom pay attention to the use of Assisted Reproductive Technologies for helping the difficulty having a baby person. In Thailand the Child Born via Assisted Reproductive Technologies Protection Act B.E.2558 is one of the law that limit the rights to health services which allows only the licensed marriage couples and unlicensed others are not. However, the laws of many countries support the unlicensed couples to have this kind of rights that represents the equality of the rights to health service amongst all kind couples, in contrary, some countries do not support such thing. Finally, we suggest that the existing Assisted Reproductive Technologies in Thailand legislations must be edit to let the unlicensed couples could have the chance to access the rights to health service via means of Biotechnology. Moreover, the Medical Council Committee Allowance of the procedures must be presented for preventing wrong applications and promote the equality of such rights eventually.
