บทคัดย่อ
พยานหลักฐานทางนิติวิทยาศาสตร์ที่มีความน่าเชื่อถือมีความสำคัญอย่างมากต่อการพิจารณาตัดสินคดี ทว่าปัญหา
ที่เรื้อรังของระบบงานนิติวิทยาศาสตร์ประเทศไทยได้มีส่วนทำให้ความน่าเชื่อถือของพยานหลักฐานทางนิติวิทยาศาสตร์ที่ประกอบ
ในสำนวนคดีถูกลดทอนลง ซึ่งปัญหาและสาเหตุสำคัญเกิดจากกระบวนการบริหารจัดการ รวบรวม และตรวจพิสูจน์พยาน
หลักฐานทางนิติวิทยาศาสตร์ที่ขาดประสิทธิภาพ เอกภาพ และความสอดคล้องกับมาตรฐานสากล แม้ว่าแนวทางการแก้ไขปัญหา
ต่าง ๆ จะมีการนำเสนออย่างเป็นรูปธรรมโดยนักวิชาการ ผู้ปฏิบัติงาน และผู้ที่มีส่วนเกี่ยวข้องแล้วก็ตาม ปัจจุบันการแก้ไขปัญหา
ในระบบงานนิติวิทยาศาสตร์ยังไม่เกิดเป็นรูปธรรมที่ชัดเจน ล่าสุดรัฐบาลออกประกาศสำนักนายกรัฐมนตรี พ.ศ. 2561 เรื่องการ
ประกาศแผนปฏิรูปประเทศ ด้านกระบวนการยุติธรรม ประเด็น “การปฏิรูประบบนิติวิทยาศาสตร์เพื่อความถูกต้องสมบูรณ์ของ
ข้อเท็จจริงแห่งคดี” เพื่อตอบสนองต่อปัญหาที่เกิดขึ้นในระบบงานนิติวิทยาศาสตร์ แต่ทว่าแผนดังกล่าวยังคลุมเครือในแนวทาง
ปฏิบัติและครอบคลุมปัญหาที่มีในปัจจุบันไม่ครบถ้วน เพื่อเป็นการสนับสนุนและส่งเสริมแผนการปฏิรูปประเทศดังกล่าว บทความนี้
จึงมุ่งศึกษาเพื่อสังเคราะห์องค์ความรู้เกี่ยวกับมาตรฐานระบบงานนิติวิทยาศาสตร์ ศึกษาระบบงานนิติวิทยาศาสตร์ประเทศไทยและเปรียบเทียบกับต่างประเทศ และเสนอโอกาสในการพัฒนาระบบงานนิติวิทยาศาสตร์ประเทศไทยและแบบจำลองมาตรฐาน
ระบบงานนิติวิทยาศาสตร์เพื่อการปฏิรูปประเทศไทยที่ยังไม่เคยปรากฏมาก่อน ซึ่งครอบคลุมการแก้ไขปัญหาที่มีอยู่อย่างครบ
วงจร ปฏิบัติตามง่าย และมีความเป็นสากล สามารถนำไปเป็นต้นแบบในการออกเป็นกฎหมาย ระเบียบ และปฏิรูประบบ
นิติวิทยาศาสตร์ประเทศไทยให้เกิดผลเป็นรูปธรรม อันจะส่งผลให้พยานหลักฐานทางนิติวิทยาศาสตร์เป็นพยานหลักฐานที่มีความ
น่าเชื่อถือในการพิจารณาคดีและเพิ่มประสิทธิภาพการอำนวยความยุติธรรม
