บทคัดย่อ
การศึกษาวิจัยแนวทางการนำวิธีระงับข้อพิพาททางเลือกมาใช้ในข้อพิพาทที่เกี่ยวกับการบุกรุกที่สาธารณะในพื้นที่อำเภอเขาพนม จังหวัดกระบี่ มีวัตถุประสงค์เพื่อวิเคราะห์ความรู้ความเข้าใจเรื่องกระบวนพิจารณาทางกฎหมายของเจ้าหน้าที่องค์กรปกครองส่วนท้องถิ่น ผู้นำชุมชนและประชาชนในพื้นที่ตำบลเขาพนม อำเภอเขาพนม จังหวัดกระบี่ ศึกษาแนวทางการระงับข้อพิพาทระหว่างรัฐกับประชาชนจากปัญหาการบุกรุกที่สาธารณะที่ไม่ต้องนำไปสู่การพิจารณาคดีในศาลและก่อให้เกิดความสมานฉันท์ โดยใช้ข้อมูลจากเอกสารงานวิจัย กฎหมาย กฎกระทรวง ระเบียบกระทรวงมหาดไทย การอภิปรายกลุ่มและการสัมภาษณ์เชิงลึกจากบุคคลที่มีบทบาทหน้าที่เกี่ยวข้องกับปัญหาการบุกรุกที่ดินของรัฐ ทั้งจากภาครัฐและประชาชน จำนวน 22 คน จากข้อมูลที่ได้มาทั้งหมดเมื่อนำมาวิเคราะห์ พบว่า แม้ภาครัฐจะมีการออกนโยบายและมาตรการทางกฎหมายมากมายหลายฉบับมาใช้แก้ปัญหาการบุกรุกและเพื่อลดคดีบุกรุกที่ดินของรัฐแล้วก็ตาม ปัญหาการบุกรุกที่สาธารณะก็หาได้ลดน้อยถอยลงตามความเข้มข้นของมาตรการทางกฎหมายแต่อย่างใดไม่ เพราะกฎหมายที่รัฐใช้มักมุ่งเน้นที่การปราบปรามและลงโทษซึ่งรัฐเป็นผู้ดำเนินการเพียงฝ่ายเดียว โดยขาดกระบวนการมีส่วนร่วมของประชาชนในลักษณะเชิงไกล่เกลี่ย ป้องกัน และนับวันยิ่งทวีความขัดแย้งที่รุนแรงระหว่างเจ้าหน้าที่รัฐกับประชาชน จากปัญหาการบุกรุกที่ดินของรัฐอันเป็นสาธารณสมบัติของแผ่นดินและที่ประชาชนใช้ประโยชน์ร่วมกัน เพื่อเป็นการลดปัญหาข้อพิพาทและการฟ้องร้องจนเป็นคดีขึ้นสู่ศาล องค์กรปกครองส่วนท้องถิ่นจึงควรมีแนวทางปฏิบัติที่ชัดเจนในการนำวิธีระงับข้อพิพาททางเลือก หรือวิธีระงับข้อพิพาทนอกศาลมาใช้แทนการฟ้องร้องประชาชนในพื้นที่ให้เป็นคดีและต้องรับผิดในทางอาญาสถานเดียว
