มาตรการทางกฎหมายในการคุ้มครอง ส่งเสริมและพัฒนาระบบเกษตรพันธสัญญา

บทคัดย่อ
การเกษตรกรรมที่เป็นไปตามข้อสัญญาที่ทำขึ้นระหว่างเกษตรกรกับผู้ประกอบธุรกิจที่เรียกว่า “เกษตรพันธสัญญา” เป็นรูปแบบของเกษตรกรรมร่วมสมัย ที่มีการผสมผสานของการจ้างทำของ การจ้างแรงงาน และการขายผลผลิต หรือบริการทางการเกษตร ซึ่งพบว่าเกษตรกรเป็นฝ่ายเสียเปรียบไม่ได้รับความเป็นธรรมในการทำสัญญาและไม่สามารถนำกฎหมายทั่วไปที่มีอยู่มาบังคับใช้กับกรณีดังกล่าวได้อย่างมีประสิทธิภาพ ด้วยเหตุนี้ จึงต้องมีกฎหมายเฉพาะเพื่อกำกับ ดูแล คุ้มครอง และให้ความเป็นธรรมแก่เกษตรกรและผู้ประกอบธุรกิจที่เกี่ยวข้องการประกาศใช้พระราชบัญญัติส่งเสริมและพัฒนาระบบเกษตรพันธสัญญา พ.ศ. 2560 เป็นการสนองตอบความจำเป็นดังกล่าวข้างต้น และเป็นการส่งเสริม ตลอดจนพัฒนาเกษตรพันธสัญญาให้สอดคล้องกับหลักปฏิบัติสำหรับการทำเกษตรพันธสัญญาขององค์การอาหารและการเกษตรแห่งสหประชาชาติ และส่งเสริมให้ภาคธุรกิจมีความรับผิดชอบต่อสังคมในด้านสิทธิมนุษยชนตามหลักเกณฑ์ในการดำเนินธุรกิจและสิทธิมนุษยชนของสหประชาชาติ และส่งเสริมให้ภาคธุรกิจมีความรับผิดชอบต่อสังคมในด้านสิทธิมนุษยชน ตามหลักเกณฑ์ในการดำเนินธุรกิจและสิทธิมนุษยชนของสหประชาชาติ
