Online Child Sexual Abuse Situation and the Enactment of Sexual Offences against Children Act 2017 in Malaysia

Abstract

Nowadays, online child sexual abuse situation is a serious issue around the world due to advanced communication technology and the higher ability of children to access tools and the internet. In Malaysia, the child sexual abuse rate is increasing every year especially online child sexual abuse. This problem leads to the legislation of Sexual Offences against Children Act 2017. This research aims to study child sexual abuse situation and the development of sexual offences against Children Act 2017 in Malaysia including obstacles and achievement of this law. The finding indicates that the law is an effective instrument to resolve the problem but still has many weaknesses such as the justice process delayed, lacking integration among services and some authorities still do not understand child rights including the intention of the law. All weaknesses could result to be an injustice for the victims and could not give the proper protection for the children.
