Education Law and Child Protection Measures Against Offline and Cyber Bullying

Abstract
The objectives of this research are (1) to study the concept and theory related to bullying, (2) to study Thai laws and their limitation for child protection against bullying, (3) to study international agreements and laws related to education and educational institutions of selected countries; Japan, the Philippines and the United Kingdom, and (4) to propose recommendation to educational and educational institution legal measures for child protection against bullying, also extension to cyberbullying, for applying and develop Thai laws regarding child protection against bullying especially in basic educational institutions. This research employs qualitative method to conduct documentary research and in-depth interview. The research found that (1) bullying affects children and the implementation of educational institutions’ legal measures can increase the level of protection for children from bullying, (2) Thailand still has no educational legal measure for child protection against bullying, especially at the basic educational institution, (3) the study of the United Nations guideline indicates that children should have the right to concrete protecting from bullying in the educational
institution. The study of laws of Japan, the Philippines, and the United Kingdom also reveal that there are educational legal measures that could be proposesed a guideline for Thai law to create a system and allocate relevant human resources to support and reduce the problem of bullying among children in the educational institution and (4) Policies and Measures to Prevent Bullying Among Children in Basic Education Institutions announcements should imposed by the Office of the Basic Education Commission to effectively improve the protection of children from bullying.
