Legal Problems Regarding The Offence to Defraud

Abstract

Since the Criminal Code was first promulgated, provisions regarding the offence to defraud have not been amended. It was difference from the theft and the robbery which has been amended in regard to degrees of seriousness.

As Section 2 of the Criminal Code, a section grounded in the common law principle of “Nullum crimen, nulla poena sine praevia lege poenali” or “No crime, no punishment without a previous penal law”.It should be modified section 342 in terms of degree of seriousness and this offence should not be a compourdable offence in order to deter the wrongdoer.
