Legal Measures on Privacy Protection in Electronic Transaction : Case Study of Internet Cookies

Abstract
An invasion of data privacy by using cookies technology for collecting personal data was an important problem which had been concerned by almost all countries. Data Protection Law, therefore, played an important role to protect personal data used in electronic transactions. This study aimed to find out whether the Draft law on Personal Data Protection of Thailand was sufficient to protect personal data used in electronic transactions. The research revealed that the Draft law on Personal Data Protection of Thailand, unlike that in other countries, didn’t have a specific provision regarding the protection of personal data used in electronic transactions. It had only provisions which aimed to protect personal data in general. Such law, thus, was unclear, inefficient and insufficient to protect personal data, especially personal data used in electronic transactions. To resolve such problem, the author recommended that the Draft law on Personal Data Protection of Thailand should have a specific provision for the protection of personal data used in electronic transactions.
