ปัญหาระบบการเลือกตั้งสมาชิกสภาผู้แทนราษฎรแบบผสมตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560

บทคัดย่อ
รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 กำหนดให้สมาชิกสภาผู้แทนราษฎรของไทย มาจากระบบการเลือกตั้งแบบจัดสรรปันส่วนผสม ซึ่งภายหลังการประกาศใช้พระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการเลือกตั้งสมาชิกสภาผู้แทนราษฎร พ.ศ. 2561 และมีการเลือกตั้งสมาชิกสภาผู้แทนราษฎรครั้งแรก เมื่อวันที่ 24 มีนาคม 2562 ได้พบปัญหาจากระบบการเลือกตั้งดังกล่าว ทั้งปัญหาในทางข้อเท็จจริง และปัญหาข้อกฎหมาย ได้แก่ ปัญหาเกี่ยวกับวิธีการได้มาซึ่งสมาชิกสภาผู้แทนราษฎร ปัญหาเกี่ยวกับการลงคะแนนและการคิดคะแนนเสียงเลือกตั้ง และปัญหาเกี่ยวกับการกำหนดคุณสมบัติของผู้มีสิทธิสมัครรับเลือกตั้ง
ในการนี้ ผู้วิจัยได้เสนอแนะแนวทางในการพัฒนาระบบการเลือกตั้งสมาชิกสภาผู้แทนราษฎรแบบผสม ได้แก่ การนำระบบการเลือกตั้งสมาชิกสภาผู้แทนราษฎรแบบสัดส่วนผสมตามแบบประเทศเยอรมนีมาใช้ โดยใช้บัตรเลือกตั้งสองใบในการเลือกตั้งสมาชิกสภาผู้แทนราษฎรแต่ละประเภท ใบหนึ่งเลือกคนที่รัก อีกใบหนึ่งเลือกพรรคที่ชอบ สำหรับการคิดคะแนนเสียงเลือกตั้งสมาชิกสภาผู้แทนราษฎรแบบแบ่งเขตเลือกตั้งใช้วิธีคิดแบบเสียงข้างธรรมดา และสมาชิกสภาผู้แทนราษฎรแบบบัญชีรายชื่อใช้วิธีคิดคะแนนเสียงแบบสัดส่วน โดยให้มีการชดเชยความเป็นสัดส่วนกรณีมีที่นั่งส่วนเกินเกิดขึ้น ซึ่งการจะได้รับจัดสรรที่นั่งสมาชิกสภาผู้แทนราษฎรแบบสัดส่วน (บัญชีรายชื่อ) นั้น พรรคการเมืองจะต้องได้รับคะแนนเสียงไม่น้อยกว่าคะแนนเฉลี่ยต่อสมาชิกสภาผู้แทนราษฎรหนึ่งคน พร้อมทั้งเสนอให้มีการแก้ไขคุณสมบัติของผู้สมัครรับเลือกตั้งให้มีคุณสมบัติเช่นเดียวกับผู้มีสิทธิเลือกตั้ง โดยกำหนดเกณฑ์อายุให้สูงกว่า คือ เป็นบุคคลซึ่งมีสัญชาติไทย ซึ่งมีอายุตั้งแต่ 25 ปีบริบูรณ์ในวันเลือกตั้ง และไม่จำต้องสังกัดพรรคการเมืองทั้งนี้ เพื่อให้ได้ระบบการเลือกตั้งสมาชิกสภาผู้แทนราษฎรแบบผสมที่เป็นธรรม สามารถสะท้อนเจตนารมณ์ของประชาชน และมีรัฐบาลที่มีเสถียรภาพ อันเป็นการแก้ไขปัญหาระบบการเลือกตั้งของประเทศไทยที่สอดคล้องกับ “หลักสำคัญของการเลือกตั้งสมาชิกสภาผู้แทนราษฎร”
