บทคัดย่อ
พระราชบัญญัติการสอบสวนคดีพิเศษ พ.ศ. 2547 ซึ่งเป็นกฎหมายที่มุ่งเน้นปราบปรามการกระทำความผิดที่เป็นอาชญากรรมพิเศษและกำหนดมาตรการสอบสวนคดีพิเศษไว้หลายมาตรการ ซึ่งสามารถนำมาใช้เพื่อปราบปรามอาชญากรรมข้ามชาติได้ แต่จากศึกษา พบว่า พระราชบัญญัติฯ ดังกล่าวยังขาดบางมาตรการตามที่กำหนดไว้ในอนุสัญญาสหประชาชาติเพื่อต่อต้านอาชญากรรมข้ามชาติที่จัดตั้งในลักษณะองค์กร ค.ศ. 2000 และจำกัดเฉพาะการดำเนินการในกรอบภายในประเทศ ไม่สอดคล้องกับลักษณะของคดีพิเศษที่เป็นองค์กรอาชญากรรมข้ามชาติ ผู้วิจัยจึงได้ศึกษาวิจัยและจัดทำร่างพระราชบัญญัติการสอบสวนคดีพิเศษ (ฉบับที่ ..) พ.ศ. …. ที่มีหลักการสำคัญในการบัญญัติมาตรการหรือเทคนิคการสอบสวนคดีพิเศษที่จำเป็นและสอดคล้องกับมาตรการสากล เพื่อให้การบังคับใช้กฎหมายมีประสิทธิภาพในดำเนินการกับอาชญากรรมพิเศษและอาชญากรรมข้ามชาติ
