การพัฒนากฎหมายเกี่ยวกับการคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว

บทคัดย่อ
บทความวิจัยมีวัตถุประสงค์เพื่อศึกษากฎหมายและหลักการที่เกี่ยวข้องกับการคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว วิเคราะห์ปัญหาเกี่ยวกับอำนาจหน้าที่ตามกฎหมายในการปฏิบัติงานของบุคลากรประจำศูนย์พัฒนาครอบครัวในชุมชน(ศพค.) ในด้านการคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัวระดับชุมชน โดยเปรียบเทียบระหว่างกฎหมายไทย กฎหมายสหพันธรัฐมาเลเซีย และกฎหมายเครือรัฐออสเตรเลีย(เขตปกครอง Australian Capital Territory) เพื่อเสนอแนะแนวทางในการสร้างกลไกทางกฎหมายด้านการคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัวระดับชุมชน ด้วยวิธีการกำหนดอำนาจหน้าที่ในการปฏิบัติงานของบุคลากรประจำศูนย์พัฒนาครอบครัวในชุมชน (ศพค.) ให้สอดคล้องตามเจตนารมณ์ของพระราชบัญญัติส่งเสริมการพัฒนาและคุ้มครองสถาบันครอบครัว พ.ศ. 2562 การวิจัยนี้เป็นการวิจัยเชิงคุณภาพ ผลการศึกษาพบว่า แม้พระราชบัญญัติส่งเสริมการพัฒนาและคุ้มครองสถาบันครอบครัว พ.ศ. 2562 ได้กำหนดกลไกการดำเนินการบริหารงานด้านครอบครัว ในการคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัวระดับชุมชนเป็นหน้าที่ของศูนย์พัฒนาครอบครัวในชุมชน (ศพค.) แต่มิได้มีกฎหมายกำหนดอำนาจหน้าที่ของบุคลากรประจำศูนย์พัฒนาครอบครัวในชุมชน (ศพค.) ในการปฏิบัติงานไว้อย่าเป็นระบบที่ชัดเจน และเมื่อเปรียบเทียบกับกลไกการควบคุมความรุนแรงในครอบครัวของกฎหมายต่างประเทศทั้งสองประเทศ มีกฎหมายกำหนดอำนาจหน้าที่ของบุคลากรในการควบคุม ป้องกัน และแก้ไขปัญหาความรุนแรงในครอบครัวระดับชุมชนไว้เป็นรูปแบบที่ชัดเจน ดังนั้นควรปรับปรุง แก้ไข เพิ่มเติมกฎหมายโดยการกำหนดอำนาจหน้าที่ของบุคลากรประจำศูนย์พัฒนาครอบครัวในชุมชน (ศพค.) ไว้ในมาตรา 15/1 และมาตรา 33 แห่งพระราชบัญญัติส่งเสริมการพัฒนาและคุ้มครองสถาบันครอบครัว พ.ศ. 2562
