แนวทางการคุ้มครองสิทธิในการทำงานภายใต้มาตรการป้องกันและยับยั้งการแพร่ระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 (COVID-19)

บทคัดย่อ
การวิจัยครั้งนี้มีความมุ่งหมาย (1) เพื่อให้ทราบสภาพปัญหาและผลกระทบต่อสิทธิในการทำงานในช่วงการแพร่ระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 และ (2) เพื่อให้ทราบแนวทางการคุ้มครองสิทธิในการทำงานในช่วงการแพร่ระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 โดยจะเป็นการวิจัยเชิงเอกสาร การสัมภาษณ์เชิงลึกกลุ่มตัวอย่าง ได้แก่ ผู้ทรงคุณวุฒิ ตัวแทนภาครัฐและภาคเอกชน นายจ้างและลูกจ้างในหลากหลายอาชีพ และการสนทนากลุ่ม (Focus group)ผลการศึกษาวิจัย พบว่า มาตรการป้องกันและยับยั้งการแพร่ระบาดที่ประเทศไทยบังคับใช้เป็นมาตรการที่มีประสิทธิภาพต่อการควบคุมการแพร่ระบาดของโรคติดเชื้อไวรัสโคโรนา 2019 เช่น มาตรการปิดเมือง (lock down) และมาตรการห้ามออกนอกเคหะสถานในเวลาที่กำหนด (curfew) ได้ส่งผลกระทบต่อเศรษฐกิจ สังคม และสิทธิในการทำงานหลายด้าน เช่น สิทธิในการรวมกลุ่มเจรจาต่อรอง การมีงานทำ การได้รับค่าจ้างค่าตอบแทน และความปลอดภัยในการทำงาน เป็นต้น ดังนั้น การออกกฎหมายต่าง ๆ ในช่วงการแพร่ระบาดของโรคติดต่อร้ายแรง นอกจากต้องป้องกันและยับยั้งการแพร่ระบาดแล้วยังต้องคำนึงถึงสิทธิในการทำงานมากยิ่งขึ้น อีกทั้งควรมีการออกกฎหมายในเรื่องต่าง ๆ เช่น หน้าที่นายจ้างในการคุ้มครองความปลอดภัยของลูกจ้างอย่างครอบคลุม สิทธิการปฏิเสธการทำงานที่เสี่ยงของลูกจ้าง และสิทธิการลากักตัวเฝ้าดูอาการโดยไม่สูญเสียค่าจ้าง เป็นต้น
