บทคัดย่อ
บทความนี้มีวัตถุประสงค์ในการศึกษาปัญหาที่อาจเกิดขึ้นจากความไม่ชัดเจนของข้อความคิดการล่าวาฬเพื่อการวิจัยทางวิทยาศาสตร์ (Scientific Whaling) ภายใต้กฎหมายระหว่างประเทศ เมื่อพิจารณาจากบทบัญญัติที่เกี่ยวข้องในอนุสัญญาระหว่างประเทศว่าด้วยกฎเกณฑ์การล่าวาฬ ค.ศ.1946 และ การตีความและการปรับใช้อนุสัญญาโดยศาลยุติธรรมระหว่างประเทศ (The International Court of Justice หรือ “ICJ”) ในคดี Whaling in the Antarctic (Australia v Japan; New Zealand intervening) ยังคงมีประเด็นที่ไม่ชัดเจนเกี่ยวกับการล่าวาฬเพื่อการวิจัยทางวิทยาศาสตร์อยู่ กล่าวคือ ยังไม่มีกฎเกณฑ์ที่ชัดเจนเพื่อบ่งชี้ว่า การล่าวาฬเพื่อการวิจัยทางวิทยาศาสตร์ว่ามีความหมายครอบคลุมเพียงใด ผู้เขียนเห็นว่า ถ้ากฎเกณฑ์ในเรื่องนี้ยังคงไม่มีความชัดเจน ก็มีโอกาสเป็นไปได้ที่ รัฐภาคีของอนุสัญญาระหว่างประเทศว่าด้วกฎเกณฑ์การล่าวาฬ ค.ศ.1946 จะมีการล่าวาฬโดยกล่าวอ้างว่าเป็นการล่าวาฬเพื่อการวิจัยทางวิทยาศาสตร์ ทั้งที่เจตนาที่แท้จริง คือ การล่าวาฬในเชิงพาณิชย์ ปัญหาดังกล่าวอาจแก้ไขได้โดยผู้เขียนนำเสนอให้มีการกำหนดบทนิยามการล่าวาฬเพื่อการวิจัยทางวิทยาศาสตร์ในกฎเกณฑ์ที่มีค่าบังคับอย่างอ่อน (soft law) เพื่อให้ข้อความคิดการล่าวาฬเพื่อการวิจัยทางวิทยาศาสตร์มีความชัดเจนยิ่งขึ้น
