บทคัดย่อ
บทความนี้มีวัตถุประสงค์เพื่อศึกษาและเปรียบเทียบมาตรฐานทางกฎหมายและกระบวนการยุติธรรมทางอาญาสำหรับเยาวชนที่มีความผิดปกติทางจิตเกี่ยวกับการยกข้ออ้างความวิกลจริตระหว่างระบบกฎหมายจารีตประเพณีของสหรัฐอเมริกา และระบบกฎหมายลายลักษณ์อักษรของไทย ผลการศึกษาพบว่า สหรัฐอเมริกามีการใช้เกณฑ์ทางกฎหมายที่หลากหลาย ได้แก่ หลักเกณฑ์แม็คนอตัน (M’Naghten) หลักเกณฑ์แรงกระตุ้นที่ไม่อาจต้านทาน (Irresistible Impulse Test) หลักเกณฑ์เดอรัม (Durham Rule) และหลักเกณฑ์ของของสถาบันเนติบัณฑิตประเทศสหรัฐอเมริกา (American Law Institute Test) ซึ่งสะท้อนความแตกต่างระหว่างการตีความที่มุ่งคุ้มครองสิทธิในกระบวนการยุติธรรมและการเน้นมาตรการฟื้นฟู โดยคดี Golden v. State ศาลรัฐอาร์คันซอปฏิเสธข้อต่อสู้ความวิกลจริตเพื่อเน้นการฟื้นฟู คดี State in Interest of H.C ศาลรัฐนิวเจอร์ซีย์ยอมรับการยกข้อต่อสู้ความวิกลจริตบางส่วน เพื่อให้ความสำคัญกับการบำบัดฟื้นฟูแทนการลงโทษ และคดี Winburn v. State ศาลรัฐวิสคอนซินยอมรับข้ออ้างวิกลจริตโดยตรง สำหรับประเทศไทย คำพิพากษาศาลฎีกาที่ 8743/2544 ได้วางแนวทางให้พิจารณาเจตนาและความสามารถในการรับผิดเป็นรายกรณี อันเป็นแนวทางที่แตกต่างจากสหรัฐฯ ผู้เขียนเสนอแนะว่า ประเทศไทย ควรบัญญัติหรือกำหนดแนวทางทางกฎหมายที่สะท้อนถึงระดับไร้ความสามารถโดยสาระสำคัญ และควรเพิ่มบทบาทของจิตแพทย์และนักจิตวิทยาในฐานะผู้เชี่ยวชาญในกระบวนการพิจารณาคดี ตลอดจนควรจัดทำแนวปฏิบัติกลางหรือข้อบังคับในการพิจารณาคดีอาญาของเยาวชนที่มีความผิดปกติทางจิต เพื่อสร้างเอกภาพและความยุติธรรมในกระบวนการยุติธรรมไทย
