ความจำเป็นและแนวทางในการบัญญัติกฎหมายเพื่อการคุ้มครองผู้หญิงที่ถูกกระทำด้วยความรุนแรงเป็นการเฉพาะ

บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาทางกฎหมายที่เกิดขึ้นภายใต้พระราชบัญญัติส่งเสริมการพัฒนาสถาบันครอบครัว พ.ศ. 2562 ของประเทศไทยโดยมุ่งเน้นปัญหาความไม่ชัดเจนในการบังคับใช้กฎหมาย นอกจากนี้งานวิจัยนี้เปรียบเทียบและวิเคราะห์กฎหมายที่เกี่ยวข้องของประเทศสหรัฐอเมริกา ประเทศออสเตรเลีย ประเทศเยอรมนี และประเทศไทย โดยใช้วิธีการวิจัยเชิงคุณภาพผ่านการวิเคราะห์เอกสารจากกฎหมาย งานวิชาการและเอกสารที่เกี่ยวข้อง ผลการวิจัยพบว่าพระราชบัญญัติส่งเสริมการพัฒนาสถาบันครอบครัว พ.ศ. 2562 ของประเทศไทยยังคงมีความไม่ชัดเจนหลายประเด็นทำให้เกิดปัญหาในการบังคับใช้กฎหมายหลายประการไม่ว่าจะเป็น ปัญหาคำสั่งคุ้มครองที่ไม่สามารถให้ความคุ้มครองแก่ผู้เสียหายได้อย่างเพียงพอและมาตรการให้ความช่วยเหลือผู้ถูกข่มขืนที่ไม่มีประสิทธิภาพ จากการเชิงเปรียบเทียบพบว่า ประเทศสหรัฐอเมริกาและประเทศเยอรมนีมีกฎหมายเป็นการเฉพาะ เพื่อจัดการกับความรุนแรงต่อผู้หญิงรวมทั้งมีมาตรการให้ความช่วยเหลือแก่ผู้เสียหายที่ถูกข่มขืนเป็นพิเศษ ในขณะที่ประเทศไทยใช้พระราชบัญญัติส่งเสริมการพัฒนาสถาบันครอบครัว พ.ศ. 2562 มาปรับใช้กับความรุนแรงต่อผู้หญิง ทำให้การช่วยเหลือผู้เสียหายยังไม่เพียงพอ ดังนั้นงานวิจัยจึงเสนอให้มีการจัดทำกรอบกฎหมายเป็นการเฉพาะสำหรับการจัดการความรุนแรงต่อผู้หญิง โดยประกอบด้วย (1) การจัดให้มีบริการช่วยเหลือเฉพาะสำหรับผู้ที่ประสบความรุนแรงทางเพศ และ (2) เพิ่มการลงโทษผู้กระทำความผิดซ้ำในการกระทำความผิดทางเพศออนไลน์
