บทคัดย่อ
งานวิจัยนี้มีวัตถุประสงค์ 1. เพื่อศึกษาแนวคิด ขอบเขต ลักษณะของกฎหมายลิขสิทธิ์ สิทธิบัตร เครื่องหมายการค้า และความลับทางการค้าของประเทศไทย สหรัฐอเมริกาและอังกฤษในการให้ความคุ้มครองแก่อุตสาหกรรมการบริการอาหาร 2. เพื่อศึกษาวิเคราะห์การให้ความคุ้มครองทรัพย์สินทางปัญญาแก่อุตสาหกรรมการบริการอาหารสำหรับประเทศไทย จากการวิจัยพบว่ากฎหมายเครื่องหมายการค้ามีความเหมาะสมที่สุดที่จะให้ความคุ้มครองแก่งานสร้างสรรค์ในอุตสาหกรรมการบริการอาหาร เนื่องจากกฎหมายเครื่องหมายการค้าเป็นกฎหมายที่มีความยืดหยุ่นในการให้ความคุ้มครองสูง จึงส่งผลให้ผู้ประกอบการในอุตสาหกรรมการบริการอาหารมีการพัฒนาความคิดสร้างสรรค์เพิ่มมากขึ้น
