บทคัดย่อ
งานวิจัยเรื่องนี้มีวัตถุประสงค์เพื่อศึกษาพันธกรณีของประเทศภาคีอนุสัญญาระหว่างประเทศว่าด้วยการป้องกันมลพิษจากเรือ ภาคผนวกที่ 6 ว่าด้วยกฎข้อบังคับเกี่ยวกับการป้องกันมลพิษทางอากาศจากเรือ (International Convention for the Prevention of Pollution from Ships 1973 as modified by the Protocol of 1978 (MARPOL 73/78) Annex VI Regulations for the Prevention of Air Pollution from Ships) ซึ่งจัดทำขึ้นในกรอบขององค์การทางทะเลระหว่างประเทศ (International Maritime Organisation: IMO) เพื่อวิเคราะห์ผลดีและผลเสียที่จะเกิดขึ้นในกรณีที่ประเทศไทยเข้าเป็นภาคีภาคผนวกดังกล่าว และประเมินความเป็นไปได้ของประเทศไทยในการเข้าร่วมเป็นภาคี อีกทั้งเพื่อให้ได้มาซึ่งแนวทางในการเตรียมความพร้อมของประเทศไทยในการปฏิบัติตามพันธกรณีของอนุสัญญาดังกล่าวต่อไป ผลจากการวิจัยได้ข้อสรุปว่า การเข้าร่วมเป็นภาคีภาคผนวกที่ 6 ของอนุสัญญา MARPOL 73/78 มีผลดีต่อประเทศไทยหลายประการด้วยกัน ตัวอย่างเช่น ทำให้ประเทศไทยต้องออกกฎหมายภายในและแนวปฏิบัติที่ได้มาตรฐานตามที่องค์การทางทะเลระหว่างประเทศกำหนด และทำให้หน่วยงานที่เกี่ยวข้องมีฐานทางกฎหมายรองรับการปฏิบัติหน้าที่ เป็นต้น อย่างไรก็ดี การเข้าร่วมเป็นภาคีภาคผนวกดังกล่าวอาจส่งผลเสียต่อประเทศไทยบางประการ เนื่องมาจากความยุ่งยากในการปรับปรุงหรือออกกฎหมายภายในเพื่ออนุวัติการ นอกจากนี้ การเข้าเป็นภาคีก่อให้เกิดภาระแก่หน่วยงานของรัฐทั้งในด้านการตระเตรียมบุคลากรและงบประมาณ และก่อภาระแก่ภาคเอกชนในหลายด้าน คณะผู้วิจัยมีความเห็นว่า ในปัจจุบันประเทศไทยยังไม่พร้อมที่จะเข้าเป็นภาคีภาคผนวกที่ 6 ของอนุสัญญา MARPOL 78/79 จึงควรชะลอการเข้าเป็นภาคีไปก่อน และดำเนินการปรับปรุงกฎหมายภายในตามแนวทางของกฎข้อบังคับของภาคผนวกที่ 6 เพื่อรองรับการเข้าเป็นภาคีในอนาคต
