Juvenile Justice in Singapore : Comparative Notes to Thailand (Part 3)

Abstract

            Singapore youth court procedure, court order and judgment, and the case diversion are interesting issues and compared with the Thai juvenile justice. This article, the author explains those issues and analyzes obstacles in Thai juvenile justice, especially, in the issues in which there is no one with the child or juvenile delinquent in the procedure, as well as the limitation on the participation of the community and public prosecutor.

           The study finds that, in Singapore, in case of none of the close person to the delinquent in the procedure, the youth court will be responsible to help under the best interest of the child. Moreover, Singapore law orders that a prosecuting officer and a representative from the school shall be invited to the case conference. This will gain various aspects and the participation of the community.

           This article suggests that the law of Thailand should be amended ordering the court to help the child or juvenile delinquent in case of none of the close person with the delinquent, and ordering the community participation in the rehabilitation plan conference.
