Problems of Power Exercise of Sub-district Administrative Organizations

This research article aims to study problems of power exercise of Sub-district Administrative Organizations due to issue of regulation, administrative order, administrative act and administrative contract. The problems were caused by unduly application of principle of public law, lacking principle of legality and good faith as well as public purpose principle for duly power exercise.
According to the study, firstly, the power exercise shall have law legislated duties and regulations of those exercising administrative power. Secondly, the law shall determine who is those exercising power. Thirdly, the law shall determine power exercise principle. Fourthly, the law shall determine the power and finally the law shall determine the duties. Therefore, the administration of sub-district administrative organizations based on lawful power exercise of officer comply with the regulations according to law enacted to exercise of power for issue of regulation, administrative order, other administrative act or administrative contract to ensure the lawful duty fulfillment. It can be concluded that the causes of problems of power exercise of sub-district administrative organizations consist of those exercising power fail to comply with regulations, process and method determined by the law.
The author suggests that the correct exercise of power principle should be promoted as well as good faith, lacking principle of legality, administrative power and public purpose principle seriously.
