Changes in Real Estate Registration Model of the People’s Republic of China

Abstract

This academic article aims to present the history of changes in the real estate registration model of the People’s Republic of China due to the expanding real estate business in many countries. Therefore, the real estate registration is very important to ensure the proper legal acts relating to real estate and protect the rights of stakeholders appropriately.

The study found that many countries provided the real estate registration in order to facilitate the parties to verify real estate information including the real estate right overlap.  However, as each country had different economic, social, rules and regulations, the format and content of its real estate registration book was different. Initially, China provided a real estate registration book based on the real estate type. Later, China amended the real estate registration law to facilitate the registration process and ensure the simple check. The new effective law required that all types of real estate registrations contained in a single register book. For example, in the past, the land and house registrations required separated registration books. Then, a new law allowed the land and house registered collectively in one register book, called real estate registration. Both parties who wished to register and the registrar who was responsible for registration could obtain and grant the registration conveniently.

The author suggests that Thailand applies China’s model and content scope of real estate registration to develop Thailand’s land registration of Thailand.
