กระบวนการยุติธรรมทางอาญากับปัญหาการคอร์รัปชันทางการเมืองในประเทศไทย

บทความวิจัยฉบับนี้มีวัตถุประสงค์เพื่อศึกษาวิเคราะห์ปรากฏการณ์ การคอร์รัปชันทางการเมืองแล้วสร้างข้อสรุปเป็นหลักทั่วไป ตรวจสอบการใช้อำนาจรัฐของผู้ดำรงตำแหน่งทางการเมืองตามเจตนารมณ์ของรัฐธรรมนูญ พระราชบัญญัติประกอบรัฐธรรมนูญ และกฎหมายที่เกี่ยวข้อง นำแนวความคิดและทฤษฎีด้านกระบวนการยุติธรรมทางอาญามาใช้ในการแก้ไขปัญหา และให้ข้อเสนอแนะเชิงนโยบายเพื่อต่อสู้ ป้องกัน ป้องปราม และปราบปรามการคอร์รัปชันทางการเมืองในอนาคต
ผลการวิจัยเชิงคุณภาพทั้งโดยวิจัยเอกสารวิเคราะห์คำพิพากษาและ โดยศึกษาเฉพาะกรณีคดีตัวอย่างพบว่า ปรากฎการณ์การคอร์รัปชันทางการเมืองของผู้ดำรงตำแหน่งทางการเมืองมีลักษณะธุรกิจการเมือง ความขัดแย้งระหว่างผลประโยชน์ส่วนตัวกับผลประโยชน์ส่วนรวม จริยธรรมทางการเมือง ความชอบธรรมทางการเมือง ครอบงำการตรวจสอบควบคุมการใช้อำนาจรัฐ และความเสื่อมโทรมทางการเมือง จึงถูกควบคุมตรวจสอบการใช้อำนาจรัฐและถูกดำเนินคดีตามพระราชบัญญัติประกอบรัฐธรรมนูญว่าด้วยการป้องกันและปราบปรามการทุจริต พ.ศ. 2542 และที่แก้ไขเพิ่มเติม โดยศาลฎีกาแผนกคดีอาญาของผู้ดำรงตำแหน่งทางการเมืองพิพากษาลงโทษจำคุกและให้ทรัพย์สินตกเป็นของแผ่นดิน
ผู้วิจัยมีข้อเสนอแนะดังนี้ กลั่นกรองคุณสมบัติที่เหมาะสมและไม่มีลักษณะต้องห้าม มีความชอบธรรมขณะดำรงตำแหน่งทางการเมือง กำหนดทิศทางลดละเลิก คอร์รัปชันอย่างจริงจัง จัดระบบควบคุมตรวจสอบทั้งภายในและภายนอกองค์กร สร้างดุลยภาพที่เหมาะสมระหว่างฝ่ายบริหาร นิติบัญญัติ และตุลาการ ทำลายแรงจูงใจ คอร์รัปชันของนักการเมืองธุรกิจและนักธุรกิจการเมือง วางระเบียบกฎเกณฑ์คุ้มครองคุณธรรมของกฎหมาย และใช้กลไกภายในบุคคลควบคุมปัจจัยเสี่ยงควบคู่ไปกับควบคุมภายนอกโดยกฎหมายและกลไกทางสังคม
